Book excerpt: La creciente influencia de las constituciones sobre el derecho privado se ha hecho sentir notablemente desde hace cincuenta años, en especial gracias al reforzamiento de los controles de conformidad de las leyes a constitución y a los tratados internacionales. Hoy en día, parece que ninguna pregunta importante de derecho privado pueda recibir una respuesta que escaparía a una determinación, o al menos a una influencia constitucional.Sin embargo, el rol reconocido a la Constitución difiere de un estado al otro. Las diferencias se relacionan con múltiples y relevantes aspectos, como la existencia o no de un control de constitucionalidad y las modalidades de dicho control; la mayor o menor atracción que ejercen los recursos conferidos por la constitución en relación con los remedios clásicos del derecho privado, cuyo anquilosamiento contrasta con la eficacia y la rapidez de ciertos remedios de derecho constitucional; o las consecuencias del fenómeno sobre el método de evolución del derecho.Bajo la dirección del profesor Christian Larroumet y con la coordinación académica de Sebastián Ríos Labbé, el Tercer Congreso Internacional de la Association Andrés Bello des Juristes franco-latino-américains, que tuvo lugar los dias 5 y 6 de septiembre de 2006 en las Universidades Externado de Colombia y del Rosario, se dedicó al análisis de todas estas importantes materias. El congreso contó con la participación de cuarenta connotados profesores, venidos de Francia y de diez países de Latinoamérica. Esta obra recoge las contribuciones presentadas en dichas jornadas.Sin embargo, el rol reconocido a la Constitución difiere de un estado al otro. This volume discusses the rules which apply where a person dies either without leaving a valid will, or leaving a will which fails to dispose of all of the person's assets. Among the questions considered are the following: What is the nature of the rules for the disposal of the deceased's assets? Are they mechanical or is there an element of discretion? Are particular types of property dealt with in particular ways? Is there entitlement to individual assets (as opposed to money)? Do the rules operate in a parentelic system or a system of some other kind? Are spouses treated more favourably than children? What provision is made for extra-marital children, for adopted children, for step-children? Does cohabitation give rise to entitlement? How are same-sex couples treated? Broader questions also arise of a historical and comparative nature. Where, for example, do the rules in intestate succession come from in particular legal systems? Have they been influenced by the rules in other countries? How are the rules explained and how are they justified? To what extent have they changed over time? What are the long-term trends? And finally, are the rules satisfactory, and is there pressure for their reform? As in the first volume, this book will focus on Europe and on countries which have been influenced by the European experience such as Australia, New Zealand, South Africa, the United States of America, Quebec, and the countries of Latin America. Book excerpt: Amorcé par l’arrêt Köbler, un mouvement jurisprudentiel récent a conduit la Cour de justice à concevoir divers mécanismes qui permettent aux justiciables de sanctionner, directement ou indirectement, une juridiction nationale qui a méconnu son obligation de renvoi préjudiciel. C’est ainsi que les justiciables pourront solliciter la remise en cause de la chose décidée, voire de la chose jugée ou encore, chercher à engager la responsabilité «judiciaire» de l’État. On pressent pourtant que les solutions, très restrictives, forgées par la Cour de justice sont supplantées par les dispositifs nationaux. Ceux-ci paraissent en effet plus aisés à actionner, voire plus performants, qu’il s’agisse de la violation du droit au juge légal, comme en Allemagne ou en Espagne, ou encore de l’introduction du dispositif législatif suédois. Book excerpt: This book examines the implications of Article 12 of the UN Convention on the Rights of Persons with Disabilities (CRPD), its resulting standard of protection for persons with disabilities and the way it is understood and implemented in its diverse signatory states. Its overarching theme is to assess the impact of CRPD Article 12 on the private law concept of legal capacity and its limitations, the significance of which carries over into the realm of penal law regulations. Its impact is analysed primarily from the legal point of view, but with due regard for its psychological and psychiatric ramifications. Recognising the importance of these disciplines is important when implementing CRPD Article 12 into domestic law, as they contribute to the determinants in creating a qualificatory legal framework for all, persons with disabilities in particular, to exercise their rights to legal capacity without let or hindrance. As active legal capacity is a notion rooted in and coming from private law, this forms the main research perspective. The first section discusses the foundational concepts constituting the CRPD Article 12 standard from domestic private law and international law perspectives.
