Discrimination can occur where secular employers refuse to employ or accommodate religious employees, as well as where religious groups refuse to employ those of a different religion, or those of the same religion whose interpretation or practice of the faith differs. Adding to the complexity is the fact that freedom of religion is protected as a fundamental human right which may be enjoyed by both religious individuals and religious groups. Although it is not an absolute right, its importance to individuals means that religious freedom may warrant a degree of protection in the work context. The book begins with a study of the basis for protecting religious freedom and considers the extent to which that right should be exercised in specialised context of the workplace. It takes a comparative approach, considering the position in other common law jurisdictions, and within the European Union. It locates the debate surrounding these issues within a philosophical and theoretical framework in which the importance of freedom of religion, and its role within the workplace is fully debated.

Throughout our history, religious dissenters and minorities have found protection in our laws and institutions, from Quaker conscientious objectors during the Civil War to Jehovah's Witnesses refusing to recite the pledge of allegiance in school during World War II, among many others. However, as with other foundational rights, our country has not always lived up to the promise of religious freedom and equal treatment for all. Roman Catholics and Mormons in the 19th century, Jews in the 19th and 20th centuries, and many others have experienced discrimination - and even at times persecution - throughout our history. In light of this, Congress has enacted a number of laws that prohibit religion-based discrimination. For example, several provisions of the landmark Civil Rights Act of 1964 contain explicit protections for religion, including Title II (public accommodations), Title III (public facilities), Title IV (education), and Title VII (employment). Likewise, the Fair Housing Act of 1968 forbids discrimination based on religion. More recent statutes include the Religious Land Use and Institutionalized Persons Act, which prohibits local governments from adopting or enforcing land use regulations that discriminate against religious assemblies and institutions, or which unjustifiably burden religious exercise. This law also protects the religious exercise of persons confined to certain institutions. There are also a number of Federal statutes that criminalize acts of violence based on religion or directed towards houses of worship, including the Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act of 2009. These federal laws have been, and continue to be, enforced by a range of Federal agencies.

Dale (2000) and Elk Grove Unified School District v. Newdow (2004). These rulings created a new, discriminatory level of distinction for believers versus non-believers that is ahistorical in light of previous Supreme Court precedent. Both cases created new standards for analyzing equality under the law for non-conformists such as atheists, shaping a new hierarchy of protected and unprotected forms of religious belief. The new judicial standards elevate monotheistic religious belief over the neutrality standard that had been heralded in prior Supreme Court decisions and create a kind of American Civil Religion.
