Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Available in PDF, EPUB and Kindle. Book excerpt: In this chapter, we present an outline of the economic analysis of the regulation of unions and collective bargaining. We begin with the simple model of the market for union services and analyze regulations that may increase or decrease either the demand or supply for union representation. In this way we provide an economic basis for evaluating government policies such as a prohibition on yellow dog contracts, a prohibition on discriminatory discharges, right to work laws and card check procedures for selecting a union, which may influence the demand and supply for union services and accordingly union density in the economy. Next we present simple expositions of the primary models of the impact of unions on wages and employment, including the monopoly model, the efficient contract or collective voice model and the median voter model. These models provide the basic framework for analyzing the impact of collective bargaining on equity, efficiency and voice. Finally, we discuss the concept of bargaining power and present two simple models of collective bargaining that depict the problem of strikes alternatively as a function of imperfect information and strategic behavior. These models provide a basis for evaluating government policies that are designed to change the relative bargaining power of labor and management such as allowing permanent replacements, allowing offensive lock-outs and allowing or prohibiting secondary boycotts. These models also allow us to evaluate the potential for government policies to promote cooperative labor relations and industrial peace such as requiring exchanges of information, good faith bargaining and appropriate bargaining units. The ultimate arbiter of the efficacy of various government policies is, of course, empirical work. Where appropriate, we cite the most important empirical work that is available on the examined problems.

Book excerpt: Labor unions have a long history of criminal activity related to economic crime, fraud, and other labor racketeering activities. These organizations are an appealing entity for criminals to exploit because of their rich source of funds from pensions, health and welfare packages as well as lack of government regulation. For years, the amount of funds misappropriated from union members has been extraordinarily large and exponentially increasing. The amount of money recovered from investigations of labor racketeering and program fraud in the 2011 fiscal year was $205.9 million (includes recoveries, cost efficiencies, restitutions, fines/penalties, civil monetary actions, fines, forfeitures and court costs) which was a 155% increase from 2010 and a 302% increase from 2008. Criminal organizations will continue to use labor unions as a tool to further the goals of their criminal activity without the implementation of preventative measures. Government regulations impose some operational and reporting requirements, but for the most part were developed to codify the criminality of undesirable activity. Because of this, labor unions are left to govern their own operations. In an ideal world this is not a problem, but many labor unions are lacking the responsibility of implementing appropriate corporate governance policies that are preventing criminal activity. In previous situations where entities were unable to govern themselves in a way that stimulated ethical behavior and imposed strong internal controls, the government took control through empowering regulations. Labor unions are going through a similar situation where they are unable to govern themselves and need guidance in the form of government regulation.
