Book Comparative Consumer Insolvency Regimes

Download or read book Comparative Consumer Insolvency Regimes written by Jacob Ziegel and published by Bloomsbury Publishing. This book was released on 2003-09-22 with total page 212 pages. Available in PDF, EPUB and Kindle. Book excerpt: All modern legal systems with advanced economies must address the question of how to respond to the needs of insolvent consumers whose burden of debt greatly exceeds their capacity to repay within a reasonable time frame. This study surveys comparatively the insolvency regimes currently in place or likely to be adopted in the foreseeable future in Canada, the United States, Australia, England and Wales, Scotland, Scandinavia and a representative group of Western countries on the continent of Europe. Modern legal systems have two basic alternatives in providing relief for over-committed consumers. The first, which involves restricting the enforcement of individual creditor remedies is a method with which this study is not concerned. Where the consumer is seriously insolvent and owes money to many creditors, a different approach is required -- a collective solution to debtor's problems – and this, the solution provided by modern insolvency systems, is the focus of this study.

Book excerpt: With changes in the federal bankruptcy laws in effect as of October 17, libraries will want to have up-to-date guidance for their interested patrons. Raum, in addition to being a newscaster at National Public Radio, is a practicing attorney with expertise in personal bankruptcy. She guides those in financial difficulty to an understanding of what bankruptcy is and helps them evaluate it as an option. She explains the differences between Chapter 7 bankruptcy (liquidation) and Chapter 13 (reorganization), as well as alternatives to filing. She provides a basic rundown on the process, including filing the petition and attending the hearing. There is advice on re-establishing credit, choosing and hiring a lawyer, avoiding credit scams, and moving on after bankruptcy. The appendixes provide illustrative worksheets and forms and a 50-state chart on homestead exemptions. Similarly, editors of Socrates Media cover the essential elements of the bankruptcy process. Readers learn what it means to go bankrupt and how it is accomplished. There is an excellent explanation of the homestead exemption rules that may protect a home in a bankruptcy proceeding, and a good chart comparing the old bankruptcy law and the new. There is information on Canadian bankruptcy, and appendixes include a glossary, a list of online resources related to consumer credit, and one for legal search engines. The book comes with a CD that contains an electronic version of the information, a legal dictionary and links to financial management forms and tools (registration required). Book excerpt: Trustees at Work explores the role bankruptcy trustees play in determining who qualifies as a deserving debtor under Canadian personal bankruptcy law. The idea of a deserving debtor is woven throughout bankruptcy law, with debt relief being reserved for those debtors deemed deserving. The legislation and case law invite trustees to assess debtors based on their pre-bankruptcy choices, but in practice, trustees evaluate debtors based on how cooperative the debtors are during bankruptcy proceedings. This book uses interviews and statistical data to explain how the financial and emotional pressures of trustees’ work shape their decision-making process.
