Book excerpt: Enacted in 1975, the Education for All Handicapped Children Act – now called the Individuals with Disabilities Education Act (IDEA) provides all children with the right to a free and appropriate public education. On the face of it, the IDEA is a shining example of law’s democratizing impulse. But is that really the case? In Disabled Education, Ruth Colker digs deep beneath the IDEA’s surface and reveals that the IDEA contains flaws that were evident at the time of its enactment that limit its effectiveness for poor and minority children. Both an expert in disability law and the mother of a child with a hearing impairment, Colker learned first-hand of the Act’s limitations when she embarked on a legal battle to persuade her son’s school to accommodate his impairment. Colker was able to devote the considerable resources of a middle-class lawyer to her struggle and ultimately won, but she knew that the IDEA would not have benefitted her son without her time-consuming and costly legal intervention. Her experience led her to investigate other cases, which confirmed her suspicions that the IDEA best serves those with the resources to advocate strongly for their children. The IDEA also works only as well as the rest of the system does: struggling schools that serve primarily poor students of color rarely have the funds to provide appropriate special education and related services to their students with disabilities. Through a close examination of the historical evolution of the IDEA, the actual experiences of children who fought for their education in court, and social science literature on the meaning of “learning disability,” Colker reveals the IDEA’s shortcomings, but also suggests ways in which resources might be allocated more evenly along class lines.

Book excerpt: Focusing on Massachusetts' innovative special education reform law, Chapter 766, "Reforming Special Education" traces the complex processes through which an ostensibly universalistic and equitable policy can produce a biased distribution of public benefits favoring affluent clients."Reforming Special Education" examines three Massachusetts school systems and seven schools within those systems to determine whether laws formulated to alter practices in educating children who are deaf, blind, retarded, and physically handicapped actually result in fair and uniform treatment of children with special needs, or whether they just create more work for school personnel.The book discusses individual and community wealth as factors in the allocation of funds. Despite Massachusetts' "equalizing formula," it points out that rich districts often fare better than poor ones because they have the resources and sophistication necessary to challenge funding decisions. The book also reveals that bureaucrats who are charged with carrying out the changes are victimized by new laws which, for lack of resources, they cannot hope to put into effect. Because the street-level bureaucrats, front-line personnel, develop informal means of coping with these problems and with their jobs, they distort the policy they are charged with implementing and become policy makers in their own right.Weatherley concludes that policy initiatives must take into account potential effects on the daily work routines of those charged with implementing them. These findings have dramatic implications for all human service bureaucracies where front-line staff interact with the public--hospitals, police departments, public welfare and employment offices, mental health centers and lower courts. Students of public policy, educators, social workers, or anyone involved in public service employment will find this a scholarly, yet highly readable account of the organizational constraints to bureaucratic reform.

IDEA affords individuals with physical or cognitive disabilities (through age 21) a free appropriate public education, an individualized education plan, and many accommodations in an attempt to include those with disabilities in the educational experience. Throughout its brief history, the party in power has, through amendment of the law, presidential action or inaction, or litigation opened the door to those with disabilities in some cases and supported de facto exclusion in others. This paper displays a timeline tracing the effects of the legislation, in its various forms, on the disabled populace. All manifestations of the law will were examined: from its origin during the Ford administration; amendments in the George Herbert Walker Bush and Clinton administrations, to reauthorization under the current government. Corresponding litigation brought by advocates and opponents was dissected as to its effects on education access for those with disabilities. Additionally, the effects of educational reform on students with disabilities are examined by discussion of the controversial "No Child Left Behind" law.
