Book excerpt: Excerpt from Reflections on the Changes Which May Seem Necessary in the Present Constitution of the State of New York The formation or revision of a constitution is as noble a task as the erection of those great cathedrals, toward the rearing of which it was the habit of calling on every one to contribute his share of work or means, however humble it might be and in obedience to your call I shall cheerfully offer my contribution to the building up of our constitution or at least I shall write my views as to the principal points to be looked to in the formation of a new constitution, to use the words of the resolution which you have communicated to me, distinctly understanding that the Club, in publishing my views, makes itself in no way answerable for them, but gives them as the Opinions of a fellow-citizen on subjects of great public interest. Demosthenes, in one of his great speeches, mentions the daily and hourly repeated Athenian question, And what's the news? Let me consider the call of our Club like the frequent American question, What do you think about this matter - put more solemnly, more singling out, indeed, but still addressed by friends to a friend. I beg you, dear sir, to convey my sincere thanks to the Club, and to assure our fellow-members that, however unsuccessful I may be, or however my convictions may occasionally differ from the views of some of them, I shall write down what they have asked for, conscious of the weighty importance attached to the topic, and that not a line will be written either from the love of some theory, or in the temper of a partisan, or in the pliable Spirit of a courtier to his sovereign, although the sovereign with us be called the people. Courts and juries, gentlemen, do not count votes to determine whether a constitution has been adopted or a gov erner elected or not. Courts take notice, without proof offered from the bar, what the constitution is or was, and who is or was the governor of their own State. It belongs to the Legislature to exercise this high duty. It is the Legislature which, in the exercise of its delegated sovereignty, counts the votes and de clares whether a constitution be adopted or a governor elected or not, and we cannot revive or reverse their acts in this par ticular, without usurping their power. And why not? Be cause if we did so we should cease to be a mere judicial, and become a political, tribunal, with the whole sovereignty in our hand; neither the people nor the Legislature would be sover eign we should be sovereign, or you would be sovereign. Sovereignty is above courts and juries, and the creature can not sit in judgment upon its creator. The admirable statement of the principle that on this subject in this particular, if the Legislature pronounces a government to be constitutional and valid, it is not in the power of its courts to pronounce such government unconstitutional and void, was quoted in full by Mr. Webster, in his argument of the Rhode Island ease, Luther v. Borden, before the Supreme Court. That Court gave upon this point a unanimous judgment, and refer to the clear and forcible opinion of the Supreme Court of Rhode Island, in the trial of Dorr. Book excerpt: Excerpt from Some Defects in the Constitution of the United States: An Address to the Law Department of the University of Pennsylvania, 27 April, 1906 That the Constitution thus framed was reactionary was a matter of course. There was, as we know, some talk of a royal government, with Frederick, Duke of York, second son of George the Third, as King. Hamilton, whose subsequent great services as Secretary Of the Treasury have crowned him with a halo, and whose tragic death has obliterated the memory of his faults, declared himself in favor of the English form of government, with its hereditary Executive and its House of Lords, which he denominated a most noble insti tution. Failing in that, he advocated an Executive elected by Congress for life, Senators and judges for life, and governors of States to be appointed by the President. Of these he secured, as it has proved, the most important from his standpoint, the creation of judges for life. The convention was aware that a Constitution on Hamilton's lines could not secure ratification by the several States. But the Constitution adopted was made as undemocratic as possible, and was very far from responding to the condition, laid down in the Declaration of 1776, that all governments derive their just powers from the consent of the governed. Hamilton, in a speech to the convention, stated that the members were agreed that we need to be rescued from the democracy. They were rescued. Thomas Jefferson unfortunately was absent as our minister to France and took no part in the convention, though we owe largely to him the compromise by which the first 10 amendments were agreed to be adopted in exchange for ratification by several States which other wise would have been withheld.
