Book excerpt: The Broadband Cost Reduction Directive (BB CRD) of 2014 aims to reduce the costs of deploying high-speed broadband networks through facilitating shared use and coordinated deployment of physical infrastructure within the electronic communications sector and across other sectors such as energy, transport and water, streamlining permit granting procedures and facilitating access to end users' premises. In this study, we define a methodology and gather data to assess the current status of implementation of the Directive, its impact on market outcomes and progress made towards achieving its objectives since the date of application of the Directive in July 2016. We also identify best practice examples of access and co-deployment regimes as well as standards for in-building infrastructure, based on case studies and interviews. As little time has passed since the Directive's transposition, no firm conclusions can be drawn concerning the impact of the Directive on reducing the cost of broadband deployment or achieving more ambitious targets in line with the Gigabit society. However, evidence from countries which previously applied provisions similar to those in the BB CRD, indicate that cross-sectoral collaboration can enable significant cost reductions, supporting the more widespread deployment of very high capacity broadband. Achieving these benefits may however require a more pro-active approach of Member States to implementing the provisions of the BB CRD.

There is a need to review the Directive, because there have been a number of technological, market and policy developments since it entered into force in 2016. In this report, we provide an overview of how the BCRD has been applied across the EU, and evaluate each of the measures as well as the Directive as a whole. We conclude that, where it has been effectively applied, the BCRD has contributed to increased fixed and wireless high-speed broadband deployment amounting to at least 100,000km of additional network roll-out between 2016-2020, reducing the digital divide and delivering the associated benefits of economic growth, greater urban rural cohesion and the delivery of social care and education. However, although the overall benefits outweigh the associated costs, some provisions have been more intensively applied than others and outcomes are variable. There is thus considerable scope to refocus and improve the BCRD to better and more efficiently contribute to the Gigabit society goals, including deployment of wireless broadband such as 5G.

This is the fourth study of the region (formerly under the title 'Competitiveness in South East Europe') and it comprehensively assesses policy reforms in the WB6 economies across 15 policy areas key to strengthening their competitiveness. It enables WB6 economies to compare economic performance against regional peers, as well as EU-OECD good practices and standards, and to design future policies based on rich evidence and actionable policy recommendations. Book excerpt: This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes.
