Book excerpt: Los nuevos planteamientos productivos implican la necesidad de maximizar la rentabilidad de la actividad productiva, ajustando para ello la producción a la demanda, produciendo tan sólo el número de producto que en cada momento se asuma por los consumidores. Las empresas han de tener capacidad suficiente para ofrecer una respuesta inmediata a los cambios de la demanda (ascendente o descendente), pudiendo resolver cualquier fluctuación en las demandas del mercado. Lógicamente ello supone romper la homogeneidad en buena parte de las condiciones de trabajo, y ello es evidente en el tiempo de trabajo, pues repercute en que los ciclos de trabajo y descanso dejen de ser homogéneos. En esta obra monográfica ponemos de manifiesto los problemas jurídicos que la introducción de la flexibilidad en la relación de trabajo y la adaptabilidad del tiempo de trabajo a las necesidades de la empresa, genera para el trabajador, al producirse una pérdida de control por parte de éste del tiempo; tanto del tiempo de trabajo como del tiempo de descanso. La aparición, tras la crisis sanitaria, de nuevos instrumentos de flexibilidad y nuevas formas de organización del trabajo han repercutido directamente sobre la regulación legal y convencional del tiempo de trabajo.
