Solo con l’attività di riparazione del danno e con la spinta da parte della societas verso questo tipo di approccio l’attività di impresa nel suo insieme può dirsi sostenibile. Perché se un reato è stato commesso e se il Modello non è stato in grado di prevenire eventi dello stesso tipo di quello che si è verificato, oltre al rafforzamento delle regole di compliance, oltre alle modifiche migliorative del MOGC è necessario attuare un sistema 231 maggiormente orientato in senso riparatorio che possa ricucire lo “strappo” cagionato all’ambiente dalla commissione del reato.

In particolare, vengono esaminate le disposizioni che sanciscono tale responsabilit in relazione: á ai reati in tema di concussione e corruzione, anche tra privati (ex L. n. 190/2012); á ai reati ambientali (ex D.Lgs. n. 121/ 2011); á al reato di impiego di lavoratori stranieri irregolari (ex D.Lgs. n. 109/2012); á alla protezione dei minori, a seguito del recepimento della Convenzione di Lanzarote (ex L. n. 172/2012). Il dettaglio dellŐanalisi poi affidato a specifici capitoli che per ogni fattispecie ripercorrono: á la genesi della norma e la sua fonte; á le modifiche apportate al quadro normativo previgente e lŐeventuale raffronto con il precedente disposto di legge; á le specificit legate a ciascuno dei reati richiamati (in tema di condotta, elemento oggettivo e soggettivo, sanzioni e specificit), anche ai fini di una corretta identificazione delle modalit di commissione di ciascun reato presupposto; á i principali impatti che le modifiche normative avranno sulla disciplina della responsabilit amministrativa degli enti e sulle modificazioni che si renderanno necessarie al fine di consentire lŐaggiornamento dei modelli organizzativi adottati ex D.Lgs. n. 231/2001.

Amongst the favorable characteristics for domestication we can list its high prolificacy, rapid growth rate, a herbivorous diet, social behavior and relative tameness. The genus (with only two species) is found from the Panama Canal to the north of Argentina on the east of the Andes. Chile is the only country in South America where the capybara is not found. The species is eaten all over its range, especially by poor, rural and traditional communities engaged in subsistence hunting. On the other hand, in large urban settlements wildlife is consumed by city dwellers as a delicacy. The sustainable management of capybara in the wild has been adopted by some South American countries, while others have encouraged capybara rearing in captivity.

Book excerpt: This book provides the first comprehensive overview of the most important water-related issues that centre on Italy, analysed from several disciplinary perspectives – such as hydrology, economics, law, sociology, environmental sciences and policy studies – in order to promote full understanding of the challenges the country is facing and the ways it could best tackle them. Despite the misconception that Italy is a water-scarce country, is in fact quite rich in water resources. Such resources, however, are unevenly distributed over the Italian territory. Italy’s northern regions rely on quite an abundant quantity of freshwater, whereas in the southern area water endowment is limited. Moreover, climatic differences between North and South contribute to widen the divide. This disparity has notable consequences of socio-economic character, some of which, in turn, feed back into the environmental conditions of Italian regions: pollution, floods, landslides and droughts are among the problems affecting the country. There are numerous features of water use and consumption that distinguish Italy from other comparable countries, such as the significant role played by agriculture (a water-intensive activity), a lead position in the consumption of bottled water, lower-than-average prices of water and a far-from-optimal efficiency of waterworks. All such aspects, and many others, make Italy an essential case study.
