Book excerpt: For refugees, the right to family reunification is crucial because separation from their family members causes significant anxiety and is widely recognised as a barrier to successful integration in host countries. Well-designed family reunification policies also help create the safe and legal routes that are necessary to prevent dangerous, irregular journeys to and within Europe. Despite the importance of facilitating family reunification for both refugees and European states, the trend is now towards imposing greater restrictions in this area. This paper assesses restrictions on the right to family reunification, as enshrined in United Nations human rights treaties, the case law of the European Court of Human Rights and European Union law, and shows that many of the legal and practical restrictions currently in place raise concerns from a human rights perspective. Based on this analysis, the Council of Europe Commissioner for Human Rights sets out a number of recommendations to member states intended to assist national authorities in re-examining their laws, policies and practices in order to give full effect to the right to family reunification, for the benefit of both refugees and their host communities.

The author first comments on the particular importance of the Soering judgment which confirmed that the Court, and other convention organs, may examine claims of refugees from non-signatory countries, provided that a claimant shows objectively that he faces a risk of severe ill-treatment if returned to his home country. The paper's primary focus is a review of important cases interpreting Article 8 of the Convention - the right of respect for family life. The author notes that the Convention does not guarantee non-nationals a right to enter or remain in a particular country, however, in some limited instances the exclusion of a close family member from a country wherein a relative is entitled to remain may violate the Convention. These instances are few due to the Convention's guarantee of 'respect' for family life and not a 'right' to family life. Cases reviewed include those defining what the term 'family' means in order to distinguish what relationships constitute protected family life. The boundaries of the meaning of family are defined by the status of stable and unstable heterosexual relationships, with and without children, and the status of homosexual relationships under the Convention. Other cases reviewed concern the alleged entitlement to remain with or join a spouse lawfully present in a signatory country, and the deportation of immigrants whose conditions of stay are no longer fulfilled, normally in instances where the immigrant has committed serious crime. Attention is also given to rulings concerning the Convention's prohibition against discrimination in its application, particularly in the field of sex discrimination.
