Book excerpt: Uno de los aspectos que contempla la Ley 31/1995, de 8 de noviembre, de Prevención de Riesgos Laborales (en adelante, LPRL) es la protección de los trabajadores en materia de seguridad y salud laboral. Lo más importante de esta normativa gira en torno al derecho del trabajador a ser protegido en su salud; para ello se impondrán ciertas obligaciones al empresario, considerado el principal sujeto responsable pero no el único. Los deberes que se precisan en la Ley son la incorporación de un plan de prevención en la empresa y de equipos de trabajo y de protección individual, la elaboración de un plan de emergencia, informar y formar a los trabajadores, la vigilancia de la salud, la documentación en materia de seguridad y salud, y la coordinación de actividades empresariales. Para determinados colectivos como son los trabajadores menores de edad, los trabajadores temporales y contratados por empresas de trabajo temporal, las trabajadoras en situación de embarazo, parto reciente y lactancia natural; se establecen obligaciones específicas. El incumplimiento por los empresarios de sus obligaciones en materia de prevención de riesgos laborales conllevará ciertas responsabilidades; estas pueden ser administrativas, penales y civiles. Complementando estas, el Real Decreto Legislativo 1/1994, de 20 de junio, por el que se aprueba el Texto Refundido de la Ley General de la Seguridad Social (en adelante, LGSS) constituye la responsabilidad en materia de seguridad social o el recargo de prestaciones.

Book excerpt: Durante el desarrollo de su empleo, los trabajadores se ven expuestos a unos riesgos que es preciso evitar para garantizar su seguridad laboral. Esta labor adquiere una importancia significativa cuando existen supuestos de concurrencia de varias empresas en un mismo lugar de trabajo, lo cual hace que dichos trabajadores se vean afectados por riesgos que, en principio, desconocen por no pertenecer a su actividad laboral habitual. Para dar solución a este problema, apareció la coordinación de actividades empresariales, según la cual las empresas que se vean involucradas en la concurrencia deberán llevar a cabo distintas acciones encaminadas a paliar los posibles defectos preventivos que surjan como consecuencia de que dos o más actividades diferentes ocupen un mismo espacio de trabajo. Existen además casos particulares que requieren una especial atención, tales como las empresas de trabajo temporal o las obras de construcción, que poseen unas características que hacen preciso un tratamiento más profundo para conocer los entresijos a efectos preventivos. También la representación legal de los trabajadores posee sus particularidades en esta materia y es preciso conocer sus derechos y obligaciones. En conclusión, el presente trabajo trata de realizar una revisión jurídica de los derechos y obligaciones de cada una de las partes involucradas e supuesto de concurrencia empresarial para lograr el fin de protección de la seguridad y salud de los trabajadores.
