The first is to provide information about the question of the role that doctrines and practices of international law have played in the emergence and persistence of the phenomenon of socio-cultural fragmentation, and therefore of inter-group conflict, within African states. The second is to provide original thought about the ways in which, prompted by the emergent turn in our time to minority and group rights, international law and multilateral African states have begun the long journey toward modifying those doctrines and practices that have led to such unfortunate results, and have thereby begun to make very valuable contributions to the effort to prevent and/or reduce the incidence of inter-group strife in specific African contexts. The book is not, however, limited in scope by its utilisation of Africa as a case study. The book's core is based on analysis of traditional and contemporary international legal doctrines and practices, their effects in specific contexts, as well as on the role of multilateral institutions in the prevention of internecine conflict within established states. It is hoped that, with the use of African states as case studies, the book will be a contribution to the advancement of scholarly knowledge regarding the general question of the relationship among the doctrines of international law, the activities of multilateral institutions, and the management of the problems of fragmentation and internecine strife within established states the world over. This volume is relevant to international lawyers, specialists in international politics, diplomats, theorists, minority and group rights scholars, historians, and human rights activists in general. It is particularly relevant to the African studies specialist, the statesman and the diplomat.

Book excerpt: This volume contains the first comprehensive study of legal issues arising with regard to the self-declared 'Republic of Somaliland' which, after more than 10 years of factual existence, is still facing international non-recognition. The case of Somaliland, in particular its unique position within the collapsed State of Somalia, challenges current international law doctrine regarding the interplay between non-recognition and the creation of States. Based upon an in-depth analysis of international law concerning the criteria of statehood and recognition, the author presents a legal framework against which cases of secession in the context of collapsed States should be measured. In applying this framework to the case of Somaliland, he demonstrates that the entity has established a sufficient level of peace, stability and effective governance to qualify as a State under international law. Given the legal uncertainty surrounding non-recognized de facto regimes such as Somaliland, the study finally attempts to identify legal rules which bind de facto regimes in the process of secession irrespective of their recognition as a State. Proposing a 'functional approach' to de facto regimes, the author argues that such entities are subject to obligations under international (human rights) law to the extent they are assuming governmental tasks.

Book excerpt: The book is the first comprehensive treatment of the reasons why international organizations have engaged in territorial administration, from the League of Nations in Danzig during the inter-war period, to the UN in East Timor recently and Kosovo today. Moving beyond the fashionable and misleading use of terms like 'post-conflict reconstruction' and 'state-building' to describe the role of international territorial administration, this book engages in a complex analysis of the various purposes with which this activity has been associated, some of which - for example settling disputes over sovereignty - have nothing to do with perceived local incapacities for governance. The book goes beyond territorial administration by the UN, covering the conduct of this activity by international organizations generally, thereby analyzing lesser-known projects like the EU Administration in Mostar, 1994 - 6. It addresses instances of partial as well as plenary administration, such as the role of the Office of the High Representative in imposing legislation in Bosnia and Herzegovina since 1996. By revealing the complex and diverse range of objectives which international organizations have attempted to realize through territorial administration, and establishing the commonalities and differences between the administration projects in this respect, the book establishes the contours of an international policy institution, to rank alongside 'peacekeeping' and 'humanitarian intervention.' By doing so, it provides a framework through which some of the key questions relating to such projects, concerning legitimacy, authority and applicable law, can be addressed. It also reveals a secret history of international organizations throughout the 20th Century, complementing work on their role in managing relations between states by exposing their role within particular states and non-state territories, beyond the well-documented activity of peacekeeping by military forces.
