Ils se pressent et s'empressent de rejoindre l'Europe, nouvelle " terre promise ". L'histoire de l'humanité a été de tout temps une histoire de migrations. La génétique, l'anthropologie, les textes sacrés... le confirment amplement. Hier encore, les Wisigoths, les Vandales, les Mongols, etc., déferlaient par vagues sur l'Europe. Aujourd'hui, des étrangers de toute part affluent en Europe. Faut-il s'en étonner, alors que la misère gagne et que des pays, en particulier d'Afrique, sont à la dérive ? Faut-il avoir peur de ces nouveaux " barbares " qui frappent à nos portes, alors que l'Europe a été un métissage ininterrompu de peuples et de cultures ? Tout en dressant le bilan de la politique européenne d'immigration, ce livre s'interroge sur la pertinence d'une telle politique commune, essentiellement sécuritaire, opérant par déplacement des frontières et transfèrement d'une partie des charges aux États tiers d'origine ou de transit des immigrés. On pourra certes continuer d'ériger des barrières aux frontières, de réprimer l'aide à l'immigration " clandestine " ou d'organiser des " charters de retour ", tout ceci paraît d'une efficacité limitée, face à un exode, nourri par la sécheresse, la misère, les dictatures et les guerres qui en découlent. Les digues mises en place résisteront-elles à ce déferlement humain ? Peut-on demander l'aide des dirigeants des États pour contenir ces " marées humaines " ? Ceux-là mêmes qui ont intérêt à encourager leur population à partir, notamment la partie la plus instruite et la plus contestataire, afin de sauvegarder et consolider leur pouvoir. Car l'émigration sert aussi les pouvoirs en place. Existe-t-il une politique idoine ? Au lecteur de cet ouvrage de se forger sa propre opinion. Le présent ouvrage est l'aboutissement d'un colloque organisé à l'Université François Rabelais de Tours en 2008.

Le respect des droits fondamentaux des demandeurs d’asile qui sont nombreux au sein des flux dits « mixtes » de migrants constitue pour les États membres un impératif. Le drame de Lampedusa a suscité une vive émotion et a soulevé des interrogations majeures sur le rôle de l’Union ainsi que le manque de coopération et de solidarité entre les États membres. Le rapport présente les priorités définies par la task force pour la Méditerranée et les orientations politiques dégagées par le Conseil européen, le Conseil de l’Union et le Parlement européen. Il s’attache également à analyser l’opération Mare nostrum, menée par les autorités italiennes, ainsi que l’opération Triton, coordonnée par Frontex, en Méditerranée et leurs enjeux. Les rapporteurs soulignent le caractère trop fragmenté des politiques en matière de lutte contre l’immigration irrégulière et proposent une résolution mettant en avant les différents leviers qui devraient être actionnés ainsi que les synergies possibles, notamment avec la politique étrangère et de sécurité commune.

Book excerpt: The main objective of this book is to present the on-going process of European integration via a comprehensive analysis of the institutional dynamics of, and politics linked with, the emerging migration law and policy of the European Union. More specifically, it presents the historical evolution, the main institutional legislative and policy steps, the position of, and interactions among, the different actors, and the factors impeding the formation of a common policy at EU level. On this basis a critical analysis is provided of the main institutional problems, the current policy framework, the overarching rationale as well as of the content and quality of the nascent EU migration law. The book is divided into three parts. The first two parts provide a comprehensive study of the institutional framework and the substantive EC/EU law respectively. The third and final part provides a more general analysis of the policy-making process. Since the major achievements in the field of migration are recent, the book focuses to a great extent on the post-Amsterdam era. However, for reasons of coherence and in order to better evaluate recent developments, a concise overview of the origins of this policy is provided. Moreover, special emphasis is placed on the Schengen acquis, since its mark on European affairs has been and remains pronounced. Overall the attempt has been to provide an account, which is up to date with extensive historical references and combines both an academic and practical perspective to the legal and political issues involved. The approach based on the above elements will contribute to a new understanding of the main aspects of EU migration law and its policy ramifications and will be of use to both academics and practitioners alike.

Book excerpt: European governments have re-discovered labour migration, but are eager to be perceived as controlling unsolicited forms of migration, especially through asylum and family reunion. The emerging paradigm of managed migration combines the construction of more permissive channels for desirable and actively recruited labour migrants with ever more restrictive approaches towards asylum seekers. Non-state actors, especially employer organizations, trade unions, and humanitarian non-governmental organisations, attempt to shape regulatory measures, but their success varies depending on organizational characteristics. Labour market interest associations' lobbying strategies regarding quantities and skill profile of labour migrants will be influenced by the respective system of political economy they are embedded in. Trade unions are generally supportive of well-managed labour recruitment strategies. But migration policy-making also proceeds at the European Union (EU) level. While national actors seek to upload their national model as a blueprint for future EU policy to avoid costly adaptation, top-down Europeanization is re-casting national regulation in important ways, notwithstanding highly divergent national regulatory philosophies. Based on field work in and analysis of primary documents from six European countries (France, Italy, United Kingdom, Ireland, Germany, and Poland) this book makes an important contribution to the study of a rapidly Europeanized policy domain. Combining insights from the literature on comparative political economy, Europeanization, and migration studies, the book makes important contributions to all three, while demonstrating how migration policy can be fruitfully studied by employing tools from mainstream political science, rather than treating it as a distinct subfield.

Its objective is twofold. First, it identifies the scale and nature of this new Southern European emigration and examines these migrants’ socio-economic integration in Northern European destination countries. This is achieved through an analysis of the most recent data on flows and profiles of this new labour force using sending-country and receiving-country databases. Second, it looks at the politics and policies of immigration, both from the perspective of the sending- and receiving-countries. Analysing the policies and debates about these new flows in the home and host countries’ this book shows how contentious the issue of intra-EU mobility has recently become in the context of the crisis when the right for EU citizens to move within the EU had previously not been questioned for decades. Overall, the strength of this edited volume is that it compiles in a systematic way quantitative and qualitative analysis of these renewed Southern European migration flows and draws the lessons from this changing climate on EU migration.
