The controlling necessity for additional railroad legislation is to reestablish rail road credit, which failed even before the War under the system of regulation in force, and to save from bank ruptcy and ruin many, and perhaps most, of the railroads of the country because of the extraordinary increases in wages and in prices of fuel and other materials during federal control. Unless railroad credit is reestablished, it will be impossible for the railroads to reasonably keep pace with the growth of the country or to finance any sub stantial part of their requirements for extensions and betterments, generally estimated at one billion dollars annually. Let us therefore examine what Congress has proposed to date, and determine how far it meets this fundamental necessity, and what the country faces if these proposals are really as far as Congress means to go in solving the railroad problem. Book excerpt: Excerpt from Railway Regulation: State and Interstate To meet and wisely discharge the responsibility of regulating commerce, state and interstate, to bring railways back and hold them to their legitimate business as common carriers, is the most important work in the government of this republic for this generation of man. If the great railway corporations of the country are using their unlimited power without abusing it, if they are transporting the commerce of the country at reasonable rates, with fairness to the general public, with a just regard to the rights of individuals, and without favoritism to places and persons, then they might justly regard government control and regulation as "unnecessary and meddlesome interference." If, however, the public is suffering serious wrong, if there are far-reaching abuses in the transportation of its commerce, if the railway companies are not only carrying the commerce of the country but controlling the commerce of the country, determining where it shall be massed, where the markets shall be located, and their control; if they are discriminating in favor of the large shipper, creating and fostering industrial and commercial monopoly, then there rests upon the several state legislatures and upon congress an obligation to act, and to act at once, with all the determination and patriotism commensurate with the duty to preserve government itself. Capital and labor, wherever employed in the creation of wealth, - whether in mining, or in manufacturing, or in agriculture, - in short, material production, in every field of human activity, is absolutely dependent upon transportation. Book excerpt: Excerpt from The Proposed Radical Railway Legislation: An Address Delivered Before the Faculty and Students of the University of Missouri, October 20, 1905 That there should be favoritism in the charges for rail way service is intolerable; it is, also, as contrary to the law of the land as that there shall be murder or theft. But social order is still interrupted by occasional larcenies and malicious homicides, and there is no evidence that the law against rebates is more frequently violated than those which forbid other offenses. Yet if any one can suggest a modification of the present law that will more effectually protect the public against the direct or indirect preferment of one shipper over another, through rebates or other con cessions from the published schedules of charges, the sug gestion will become, promptly and without opposition from any railway officer, a part of the Federal statute law. Public antipathy to rebates ought not, however, to be used to further the enactment of legislation having no bear ing upon that subject. To confer rate-making power upon the Interstate Commerce Commission could in no way hinder the payment of rebates; it would, on the contrary, make illegal concessions from the published schedules the only means of approximating that elasticity in railway charges which is essential to the upbuilding of industry. Book excerpt: Excerpt from Two-Cent Railroad Fare: And Other Railroad Legislation in Ohio Every year for the past six years, and nearly every year for the six years preceding, bills have been pending in the General Assembly of Ohio to reduce railroad fare from three to two cents per mile. During these years the bill - these bills have all been, substantially, alike - has been vigorously advocated, and as vigorously opposed, and in the end either defeated or postponed, only to be revived at the next session. Such a bill is now pending in the Senate. It applies to all railroads, and to all distances over eight miles. I have no doubt that public opinion in this State, moved by honest purposes, sincerely favors the bill. Petitions to the General Assembly; resolutions and platforms of political conventions; editorials and contributed articles in newspapers; personal solicitations and appeals; resolutions of traveling men's associations - all addressed to members of the General Assembly, and all urging the passage of the bill, are proof that a great many people want it. It is to those persons who sincerely hold this position, and who are moved by honest purposes to advocate it, that I offer the pages of this pamphlet. It has been often stated, and seems to be quite generally believed, that other States have, by law, established two-cent railroad fare, and the example of these States is cited as a reason for a two-cent rate in Ohio. The State of New York is more frequently mentioned than any other as having such a law. The following quotation from an Ohio daily newspaper, in reference to the Ohio bill and the New York law, fairly shows the general notion on this subject in this State: New York has had a similar law for many ears. It has not been the means of bankrupting railroads there, but traffic has increased more than enough to compensate for the decreased fare. We cannot see why it would not operate the same in Ohio.
