Book R gimes matrimoniaux Pacs Concubinage

Download or read book R gimes matrimoniaux Pacs Concubinage written by Bernard Beignier and published by . This book was released on 2014 with total page 350 pages. Available in PDF, EPUB and Kindle.

Download or read book Concubinage Pacs Mariage R gimes matrimoniaux written by Lucie Guchet and published by Puits Fleuri. This book was released on 2011 with total page 266 pages. Available in PDF, EPUB and Kindle.

Book R gimes matrimoniaux

Download or read book R gimes matrimoniaux written by Nathalie Peterka and published by Dalloz-Sirey. This book was released on 2008 with total page 330 pages. Available in PDF, EPUB and Kindle.

Download or read book Families and Estates written by International Academy of Estate and Trust Law. Annual Conference and published by Kluwer Law International B.V.. This book was released on 2005-01-01 with total page 310 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book focuses upon two themes: the definition of 'family' and the impact of the expansion of the concept of 'family' in law: and family fights over wills and estates - what recourse family members may have in challenging an estate. The first part, `The challenge of the "new family" for Law', considers the challenge both in the inter vivos and the postmortem contexts in the United States, Canada, France, the United Kingdom, Australia and New Zealand. A particular focus is upon the dramatic expansion of the definition of family from the traditional nuclear family consisting of a husband, wife and their mutual children to a definition that includes unmarried heterosexual and same sex couples living together and, in some jurisdictions to new kinds of companionate partnerships that are not based on a sexual relationship. In some jurisdictions such developments are simply an expression of sharing responsibility by allocating it in the private domain, as opposed to the public potentially through social welfare; in others, particularly in the United States, it is a defence of fundamental institutions and, with it, a defence of society itself. The second part, 'Family fights over wills and estates', examines the law in Australia, Switzerland, France, Mexico, and the United Kingdom. Its comparison of civil and common law approaches shows how the law expresses the same principle objects - protection of family and obligations towards key family members - but does so from entirely different perspectives; and where the common law which enshrined the notion of testamentary freedom is being qualified through the expanding domain of family provision legislation, the civil law which is based on codified shares and allocated responsibilities expressed through proportionate entitlements in estates, is being qualified through a range of disqualifying and varying mechanisms.

Book Cohabitation and Marriage in the Americas Geo historical Legacies and New Trends

Download or read book Cohabitation and Marriage in the Americas Geo historical Legacies and New Trends written by Albert Esteve and published by Springer. This book was released on 2016-11-03 with total page 311 pages. Available in PDF, EPUB and Kindle. Book excerpt: This open access book presents an innovative study of the rise of unmarried cohabitation in the Americas, from Canada to Argentina. Using an extensive sample of individual census data for nearly all countries on the continent, it offers a cross-national, comparative view of this recent demographic trend and its impact on the family. The book offers a tour of the historical legacies and regional heterogeneity in unmarried cohabitation, covering: Canada, the United States, Mexico, Central America, Colombia, the Andean region, Brazil, and the Southern Cone. It also explores the diverse meanings of cohabitation from a cross-national perspective and examines the theoretical implications of recent developments on family change in the Americas. The book uses data from the Integrated Public Use Microdata Series, International (IPUMS), a project dedicated to collecting and distributing census data from around the world. This large sample size enables an empirical testing of one of the currently most powerful explanatory frameworks for changes in family formation around the world, the theory of the Second Demographic Transition. With its unique geographical scope, this book will provide researchers with a new understanding into the spectacular rise in premarital cohabitation in the Americas, which has become one of the most salient trends in partnership formation in the region.

Book Rome Convention Rome I Regulation

Download or read book Rome Convention Rome I Regulation written by Alexander J. Belohlávek and published by Juris Publishing, Inc.. This book was released on 2011-01-01 with total page 1636 pages. Available in PDF, EPUB and Kindle. Book excerpt: As of 17 December 2010, the Rome I Regulation (EU Regulation 593/2008) on the law applicable to contractual obligations is directly applicable in all EU Member States with the exception of Denmark. The Rome I Regulation replaces the Rome Convention of 1980 in the EU Member States and will apply to all contracts concluded as of 17 December 2010. However, and herein lies the utility and great importance of this work, the Rome Convention and the Rome I Regulation will be applied in parallel for a significant time to come (the author himself anticipates a ten-to-fifteen year period); in the latter case to contracts made after 17 December, 2010. This is why this commentary takes into account both sources of law, in their mutual interaction and broader context. The comprehensiveness of the Rome Convention / Rome I Regulation is clearly apparent, but one of the great achievements of the author is his amassing of over 1,800 judicial decisions, most of which are furnished with a detailed commentary; where these decisions apply national laws, the latter are cited both in the original and in translation. For a number of rulings, the commentary include not only a case summary of the facts and an analysis of the conclusions drawn by the court, but also takes them as models to hypothesize what conclusions would be reached if the Rome I Regulation were to be applied.

Available in PDF, EPUB and Kindle. Book excerpt: French law displays many characteristics that set it apart in a world class of its own. It can be said to proceed from a number of independent streams that coexist despite apparent contradiction. More than half of the 2283 articles of the famous Code Civile of 1804 remain unaltered; yet French administrative judges jealously guard their prerogative to create their own public law. And yet again, since the 1974 law empowering the legislature to convene the Constitutional Council that judges the constitutionality of laws under the 1958 Constitution, the courts' distinction between 'rules' and 'fu.

Download or read book Colour Coded written by Constance Backhouse and published by University of Toronto Press. This book was released on 1999-11-20 with total page 505 pages. Available in PDF, EPUB and Kindle. Book excerpt: Historically Canadians have considered themselves to be more or less free of racial prejudice. Although this conception has been challenged in recent years, it has not been completely dispelled. In Colour-Coded, Constance Backhouse illustrates the tenacious hold that white supremacy had on our legal system in the first half of this century, and underscores the damaging legacy of inequality that continues today. Backhouse presents detailed narratives of six court cases, each giving evidence of blatant racism created and enforced through law. The cases focus on Aboriginal, Inuit, Chinese-Canadian, and African-Canadian individuals, taking us from the criminal prosecution of traditional Aboriginal dance to the trial of members of the 'Ku Klux Klan of Kanada.' From thousands of possibilities, Backhouse has selected studies that constitute central moments in the legal history of race in Canada. Her selection also considers a wide range of legal forums, including administrative rulings by municipal councils, criminal trials before police magistrates, and criminal and civil cases heard by the highest courts in the provinces and by the Supreme Court of Canada. The extensive and detailed documentation presented here leaves no doubt that the Canadian legal system played a dominant role in creating and preserving racial discrimination. A central message of this book is that racism is deeply embedded in Canadian history despite Canada's reputation as a raceless society. Winner of the Joseph Brant Award, presented by the Ontario Historical Society
