It is being submitted to Indian and Northern Affairs Canada (INAC), pursuant to Section 8 of the Territorial Lands Act, by Imperial Oil Resources Ventures Limited (Imperial). The activities in this application pertain to the borrow sites that will be required in the Inuvialuit Settlement Region (ISR) and Gwich'in Settlement Area (GSA) on Crown land in the Northwest Territories for the Mackenzie Gas Project (the project). The map listed in Appendix C shows the proposed Crown borrow sites in the ISR and GSA. The application is intended to permit removal of material from each borrow site for the period of time indicated for each site (see Table 1-5 and Table 1-6). This application is part of a suite of applications that are being submitted by Imperial which include: applications to the Inuvialuit Land Administration (ILA), and Indian and Northern Affairs Canada (INAC) for land use activities in the ISR; applications to the National Energy Board (NEB) to permit the construction and operation of the gathering system and a natural gas transmission pipeline; for the project; land use applications to the Mackenzie Valley Land and Water Board (MVLWB) for development activities in the Mackenzie Valley; applications to the Inuvialuit Land Corporation and Gwich'in Tribal Council to permit borrow site activities in the ISR and GSA on private land; applications to the Gwich'in Land Use Planning Board (GLUPB) for an amendment and an exception to the approved land use plan for the GSA. In addition to the applications, an environmental impact statement (EIS) has been filed with the Joint Review Panel (JRP) for the project. The EIS addresses the biophysical and human environment aspects of the entire project, including this application. ... Some of the proposed borrow site development activities located in the GSA will take place on lands that have been designated for special management in the Nành' Geenjit Gwitr 'it Tigwaa 'in, Working for the Land - The Gwich'in Land Use Plan dated August 2003 (Gwich'in land use plan). Development of three borrow sites in the Transportation Special Management Zone - Dempster Highway: Mackenzie River to Inuvik (the special management zone), will require approval of an exception to the Gwich'in Land Use Plan. Accordingly, an application for an exception has been submitted to the Gwich'in Land Use Planning Board to address a visibility condition in the plan. The exception application will be amended to reflect all three borrow sites. ... A memorandum of understanding (MOU) has been reached between INAC and the IRC regarding the management of granular resources on private and Crown land in the ISR. The MOU sets out the broad outline for how granular resources should be managed in the region. It describes how the needs of communities, and other regional priorities, relate to the needs of industry"--Introd.

The borrow site development activities on SSA Crown land will take place on lands that have been designated in the Sahtu Preliminary Draft Land Use Plan (SPDLUP) for general use or special management. The land use designation is identified for all of the sites in this application (see Appendix B). Some of the proposed borrow site development activities on DCR land are subject to a time-limited withdrawal from new subsurface, or surface and subsurface, interests under one of two federal Privy Council orders (withdrawal orders). These orders were issued under section 23 of the Territorial Lands Act subsequent to the Interim Measures Agreement (IMA) between the Dehcho First Nations (DCFN) and the federal and territorial governments, dated May 2001. One of the Dehcho withdrawal orders is for Edéhzhie or Home Plateau (P.C. 2002-1805). The other is intended to facilitate the settlement of the DCFN land claim (P.C.2003-1230). Both include provision for a corridor for the gas pipeline and associated infrastructure and both have an initial term of about five years. The status of the land that is associated with the proposed borrow site development activities relative to the withdrawal orders is identified in this application (see Appendix B and the foldout maps in Appendix C). In addition, land use zones that were proposed in the November 2005 version of the draft Dehcho land use plan are shown for the borrow site development activities in this application (see Appendix B). This draft is entitled Respect for the Land: The Dehcho Land Use Plan, Revised Draft Plan - November 2005"--Introd.

Three proposed borrow site development activities, 6.077P, 7.049P, and 7.155AP, will take place on lands that have been designated for general use and special management in the Sahtu Preliminary Draft Land Use Plan. The land use designation is identified in this application (see Appendix B - Land Use Designation of Proposed Borrow Site Development Activities). The proposed borrow site development activity on DCR land is subject to a time-limited withdrawal from new subsurface interests under one of two federal Privy council orders (withdrawal orders). These orders were issued under Section 23 of the Territorial Lands Act subsequent to the Interim Measures Agreement (IMA) between the Dehcho First Nations (DCFN) and the federal and territorial governments, dated May 2001. The status of the land that is associated with the proposed borrow site development, relative to the withdrawal orders is identified in Appendix B. This work scope included geotechnical investigation and related activities at 29 sites. This application for an amendment of the Type A Land Use Permit #S03S-009 (the amendment application) is being submitted to the Sahtu Land and Water Board (the Board) pursuant to Part 4 of the Mackenzie Valley Resources Management Act (MVRMA). The land use activities in the amendment application will add two new geotechnical investigation and related activity sites to the work scope permitted by Type A Land Use Permit # S03S-009. Imperial will also apply for a Land Use Permit relating to sites located on lands within the municipal boundary of the Town of Fort Good Hope. For the purpose of executing the work, three of the 29 sites permitted by Type A Land Use Permit # S03S-009, the two sites described in the amendment application and the four sites for which Imperial will seek authorization from MACA will be executed as a single program. This amendment application is part of a suite of applications that have been, or will be, submitted to various regulatory agencies in support of the program, including: an application to Government of the Northwest Territories - Municipal and Community Affairs (MACA) for a Land Use Permit relating to sites located on lands within the municipal boundary of the Town of Fort Good Hope; an application to the Aurora Research Institute for a Scientific Research Licence pertaining to the investigation of the uninvestigated sites permitted by Type A Land Use Permit # S03S-009, as well as the new sites described herein and sites described in the applications to MACA referred to above; an application to Government of the Northwest Territories - Department of Transportation for a Highway Access Permit. This application includes investigation activities that meet the threshold criteria for Type A land use permits under Section 4 of the MVLUR. Examples of activities meeting the thresholds for Type A permits, include: operation of vehicles, machines and power drilling equipment; storage of fuel in various quantities; clearing and preparation of investigation sites. ... Some of the investigation activities will take place on lands that have been proposed in the Sahtu Preliminary Draft Land Use Plan (SPDLUP) for general use and special management. Both the Fort Good Hope Infrastructure Area and the Fort Good Hope Infrastructure Area Access Road (portion outside the municipal boundary of the Town of Fort Good Hope) occur within the proposed Mackenzie River Special Management Area. With respect to protected areas, consultation with communities, planning boards and relevant agencies will be ongoing to address protected areas and special management areas. [There are two infrastructure sites proposed in the amendment application for investigation as part of the program, no borrow sites, pipeline segments or frost heave sites, or facility sites are included in the amendment application for investigation as part of the program.] ... The objective of conducting this work is to gather information on the soil and ground conditions at potential borrow source sites, stream and river crossing locations, infrastructure and potential facility sites, along a potential pipeline right-of-way. The information obtained will be used to assess the engineering and construction feasibility of a pipeline in the Mackenzie Valley and for preparing subsequent regulatory applications"--Introd.
