Book excerpt: Under the context of addressing climate change and reaching carbon neutrality, renewable energy (RE) development and the promotion of public participation in environmental decision-making are two essential initiatives in the environmental law field. Despite a green label attached with RE, its development may conflict with public environmental rights contributing to public opposition to proposed RE projects (REPs). The effectiveness of public participation is vital for the REPs as well as the success of the carbon neutrality goals. This book aims to provide suggestions for Chinese legal reform of public participation in decision-making on REPs by drawing from the English experience. Drawing insight from the English experience is novel to this book. England provides useful lessons on implementing public participation, but none of the existing literature systematically examines the legal framework for public participation in decision-making on REPs in England and in China. This book addresses this gap and examines the public's right to participate in decision-making in these jurisdictions. The book identifies the role of public participation in decision-making on REPs and identifies the related legislative issues under the Aarhus Convention, a multinational treaty on public participation. It discusses a critical issue -- 'Green on Green' tension -- arising in RE development and reveals the underlying factors contributing to this tension. This book systematically analyses the relevant requirements in English law and Chinese law. It also reviews the implementation issues in practice through an examination of case studies. The analysis in this research shows that Chinese law has improved regarding public participation in decision-making with respect to REPs. However, it also demonstrates that the current legal framework still does not adequately address all the problems that can lead to ineffective public participation. Against international and English experience, this book presents principles for best practice and proposes suggestions for Chinese legal reform in an effort to improve the effectiveness of public participation in decision-making on REPs.--Publisher.

Although some form of public participation is often required by law, agencies usually have broad discretion about the extent of that involvement. Approaches vary widely, from holding public information-gathering meetings to forming advisory groups to actively including citizens in making and implementing decisions. Proponents of public participation argue that those who must live with the outcome of an environmental decision should have some influence on it. Critics maintain that public participation slows decision making and can lower its quality by including people unfamiliar with the science involved. This book concludes that, when done correctly, public participation improves the quality of federal agencies' decisions about the environment. Well-managed public involvement also increases the legitimacy of decisions in the eyes of those affected by them, which makes it more likely that the decisions will be implemented effectively. This book recommends that agencies recognize public participation as valuable to their objectives, not just as a formality required by the law. It details principles and approaches agencies can use to successfully involve the public.

Accomplishing a net-zero greenhouse gas emissions economy in 2050 is a daunting challenge. This book explores the challenges of the energy transition from the perspectives of technological innovation, public policy, social values and ethics. It elaborates on two particular gaps in the design of public policy interventions focused on decarbonization of the energy system and discusses how both could be remedied. First, the siloed organization of public administration fails to account for the many interdependencies between the energy sector, the mobility system, digital infrastructure and the built environment. Cross-sector coordination of policies and policy instruments is needed to avoid potentially adverse effects upon society and the economy, which may hamper the energy transition rather than accelerate it. Second, energy and climate policies pay insufficient attention to the social values at stake in the energy transition. In addressing these gaps, this book intends to inspire decision makers engaged in the energy transition to embrace the transition as an opportunity to bring a more inclusive society into being.
