Book excerpt: This report analyses MoD's annual report and accounts 2004-05 (published in October 2005 - later than planned - as HC 464, session 2005-06, ISBN 0102935424) which combines MoD's annual performance report and the consolidated departmental resource accounts. Overall MoD's performance against its seven Public Service Agreement (PSA) targets has been mixed: three were "met", two were "partly met", one was "on course" to be met, and one was "not yet assessed". On recruitment and retention (partly met) all three armed services are suffering from critical shortages in various specialist trades, including aircrew and medical personnel. Although MoD reported £400m of savings in the operating costs of the Defence Logistics Organisation, the Committee criticizes the fact that not all of them could be validated. On procurement, MoD did not meet the targets relating to project time slippage. Cost decreases of £699 million were reported on the top 20 major defence equipment projects, but much of this was a result of cuts in the numbers of equipment ordered or in the capability of equipment. Losses reported in MoD's Financial Accounts totalled some £400 million, a lower figure than the previous year but still a substantial sum. Reported losses on the Landing Ship Dock (Auxiliary) programme, which involves the procurement of four transport ships, were some £100 million and further losses might arise. Another loss totalling £147 million related to a building project at the Atomic Weapons Establishment at Aldermaston. The building was unable to meet the requirement and no other use could be found for it. It is another example of substantial waste which has to avoided in the future.

Damages and Human Rights is a major work on awards of damages for violations of human rights that will be of compelling interest to practitioners, judges and academics alike. Damages for breaches of human rights is emerging as an important and practically significant field of law, yet the rules and principles governing such awards and their theoretical foundations remain underexplored, while courts continue to struggle to articulate a coherent law of human rights damages. The book's focus is English law, but it draws heavily on comparative material from a range of common law jurisdictions, as well as the jurisprudence of international courts. The current law on when damages can be obtained and how they are assessed is set out in detail and analysed comprehensively. The theoretical foundations of human rights damages are examined with a view to enhancing our understanding of the remedy and resolving the currently troubled state of human rights damages jurisprudence. The book argues that in awarding damages in human rights cases the courts should adopt a vindicatory approach, modelled on those rules and principles applied in tort cases when basic rights are violated. Book excerpt: The Home Office has made substantial improvements in its financial management since 2006, when the Comptroller and Auditor General disclaimed an opinion on its 2004-05 Resource Accounts. Further sustained improvement will still be needed over the next few years, so that good financial management becomes "business as usual" across all of the Department's operations, which will help the Department maximise the value for money of its service delivery. The Department has increased the number of professionally qualified finance staff, particularly in senior finance roles, and has improved financial governance and leadership. Improvements are also evident in the Department's financial planning and decision making; budgeting; financial monitoring and forecasting; and financial reporting. The unqualified audit opinion on its 2007-08 Resource Accounts was an important symbol of the progress made. There are areas for further improvement. The strategic management of the Department's capital programme has not been responsive enough to avoid large underspends, which amounted to £725 million over the 5 years to 31 March 2008. The Treasury has capped access to these funds at £292 million and the Department will need to deliver on the plans it has in place to use them by 2010-11. The Department also needs to develop further its understanding of the cost of its activities and the relationship between resource consumption and service outcomes. The Department recognises these issues and has been undertaking work with the aim of improving capital programme management and the basis on which decisions are made for funding allocations.

Book excerpt: The Water Services Regulation Authority (Ofwat) is the economic regulator of water services in England and Wales, with responsibility for setting price limits that allow the 22 main water companies to secure sustainable supplies at the lowest cost to the consumer. Following on from a NAO report (HCP 150, session 2006-07; ISBN 9780102944181) published in January 2007, the Committee's report finds that Ofwat needs to make changes to its regulatory system, in particular on water efficiency, data quality, and enforcement, given the increasing challenges to water supplies due to low rainfall and predictions of housing growth. Ofwat does not understand clearly how consumers use water and has not collected enough robust evidence on which water efficiency projects are most effective in helping consumers to use less water. Despite some progress, Ofwat still depends on unreliable data with regard to both supply and demand, and also needs much better data on per capita consumption. It has had some success in encouraging sustainable investment by companies, but needs to be more active in using sanctions against companies that under-perform against their commitments to meet all reasonable demands for water, while limiting environmental impacts. Ofwat should press companies to encourage more consumers to use meters by, for example, promoting the benefits of metering to consumers as well as routinely installing meters when there is a change of building occupancy.
