Book excerpt: Recognition of 'Farmer's Rights' is an attempt by developing countries to evolve a counterclaim to breeders' Intellectual Property Rights (IPRs) promoted under the TRIPs Agreement of the WTO. India is one of the first countries to have granted rights to both breeders and farmers under the Protection of Plant Varieties and Farmers' Rights Act, 2001. This multiple rights system aims to distribute rights equitably, but may pose the threat of an 'anticommons tragedy' i.e. too many parties independently possessing the right to exclude others from utilising a resource. If under-utilisation of plant genetic resources results, the Act will have negative consequences for sustaining crop productivity and for the welfare of the very farming communities it seeks to compensate.

Book excerpt: The study compares in situ seed conservation trends in two crop categories, 'pulses' crops and 'preferred' crops, in two regions of central India. It finds that in situ agrobiodiversity (seed) conservation efforts suffer statistically significant decrease in crops for which varieties 'improved' by the private or government sector are made available to farmers. This trend calls to question the seed replacement policy adopted by several governments, notably in developing countries, as also the push to promote intellectual property protection for formally developed varieties across the globe, and its potential impact on in situ agrobiodiversity conservation. The overarching approach adopted by the study was multi-disciplinary and incorporated a mixed-methods research design where the qualitative and quantitative segments received equal status at the time of data interpretation. The quantitative data used for the study derives from extensive farmer surveys conducted in the two regions using the stratified random sampling method. The results provide evidence of significantly higher in situ seed conservation trends in the 'pulses' crop category than in the 'preferred' crop category. The qualitative data collected via concurrently and sequentially conducted interviews further enriches the findings from the quantitative study and suggests that in regions where improved crop varieties are introduced, farmers have a significantly lower inclination to engage in in situ seed conservation, even for 'pulses' crops. From a legal and policy perspective, these findings strongly suggest the need to involve regional agricultural extension officers (RAEOs) in the effort to promote in situ agrobiodiversity conservation. They also suggest that in the absence of such efforts, the provisions of the Indian Protection of Plant Varieties and Farmers' Rights Act, 2001 (the PPV&FR Act) and similar laws that permit farmer level seed saving and conservation, may eventually lose their significance.

Book excerpt: This paper examines the objectives and functioning of the Plant Variety Protection and Farmers Rights Act, 2001 (PPV&FR Act) in the light of the history and current state of Indian agriculture and available plant variety registration statistics. The analysis first studies the problems faced by Indian agriculture that the law seeks to resolve. It then provides a statistical analysis of plant variety application trends under the Act to determine whether it is 'effective' in the light of the law's objectives. The paper identifies divergent policies in the agricultural sector and suggests means of streamlining the same to maximize the effectiveness of the PPV&FR Act. Doing so would further incentivize optimum growth of the private and public sector seed industry in India, and strengthen India's stand before the international community where article 27.3(b) of the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPs) continues to be under review.

At the outset, the paper examines the international obligations relating to protecting plant breeder's rights by examining the requirements under Article 27.3 of the TRIPS agreement. In doing so, the paper examines analyzes what amounts to an effective sui generis system as required under TRIPS. Further, the paper analyzes the constituents of the models currently touted by developed nations and outlined under the Union for Plant Variety Protection (UPOV, 1991) to determine the model's ability to fulfill the TRIPS requirement. In determining the question of whether UPOV embodies the efficiency required to become the sui generis system under TRIPS, the paper examines UPOV's ability to address unique needs of the developing world. Finally, the paper details the Plant Variety Protection and Farmer's Rights Act, 2001 of India and compares it with UPOV. The paper concludes that the Indian model is best suited for nations whose objectives for introducing plant breeders rights are not limited to just protecting breeders' rights but includes biodiversity conservation, farmer's rights and welfare issues are part of the agenda. The paper's highlight is in: a) discussing, in depth, the constituents of an effective sui generis system. Paul Heald of the University of Georgia has done some work on attempting to appreciate the ramifications of the term effective. Otherwise, there are no other significant contributions to this line of work; b) providing a detailed critical overview of the Indian legislation discussing plant variety protection.

Though the rights framework was foregrounded on an understanding between non-governmental organizations and industry, there is lack of clarity at both conceptual and procedural levels. In this context, Sophy K. Joseph analyses the impact of legal policy reforms during the ongoing Second Green Revolution on farmers’ customary rights and livelihood. The author discusses how the extension of private property rights to plant varieties, seeds, and other agrarian resources changed the demographic composition of the rural space, with increased migration of cultivators to the cities. The book argues that the transition from state interventionism (during the First Green Revolution) to state abstention (in the Second Green Revolution) has dramatically influenced India’s conventional agrarian practices and traditions. This work maps the evolutionary process of neoliberal economic and legal policies and its interference with primary concerns such as food security, food sovereignty, and agrarian self-reliance of the country.
