Book excerpt: Las empresas incorporan cada vez más las cámaras y otros sofisticados sistemas de videovigilancia por videocámara para satisfacer sus necesidades de seguridad o de control de la actividad laboral. Pero pocas son conscientes de que esa actividad, con independencia de las repercusiones en el ámbito del derecho a la vida privada del trabajador, constituye un tratamiento de datos que se encuentra sujeta a la normativa de protección de datos. La imágenes y sonidos cuando hacen indetificable a una persona, se consideran datos personales protegidos por el derecho a la autodeterminación informativa (art. 18.4 CE). Así lo viene entendiendo la Agencia Española de Protección de Datos, que lo ha reafirmado en la Instrucción 1/2006, de 8 de noviembre, sobre el tratamiento de datos personales con fines de vigilancia a través de sistemas de cámaras o videocámara. Lo que obliga a las empresas a hacer un juicio ponderado sobre los intereses protegidos antes de la instalación de los sistemas de videovigilancia en el lugar de trabajo y a respetar en todo caso en su adopción una serie de principios de protección de datos, entre ellos, el de calidad, proporcionalidad y finalidad del tratamiento. En este trabajo se examinan sistemáticamente y con una visión práctica, los principales problemas aplicativos suscitados a propósito del uso de la videocámaras en el contexto laboral. En particular, se analizan los supuestos de licitud de la videocámara en el ámbito laboral, los sujetos habilitados para llevar a cabo dichas operaciones, las obligaciones del responsable del fichero videográfico y los derechos de los trabajadores afectados. Igualmente, se abordan los problemas de índole procesal ligados a la utilización del vídeo como medio de prueba, en concreto, su valor probatorio y los efectos de la prueba ilícita sobre la calificación del despido. Su lectura permite a cualquier interesado, sea o no operador jurídico, adquirir las claves constitucionales del problema y tener conocimiento certero de las garantías de protección de datos que han de tenerse en cuenta para una correcta ejecución de las operaciones de videovigilancia en el ámbito de la empresa.

In 1931 distinguished economist John Maynard Keynes published a short essay, “Economic Possibilities for Our Grandchildren,” in his collection Essays in Persuasion. In the essay, he expressed optimism for the economic future despite the doldrums of the post-World War I years and the onset of the Great Depression. Keynes imagined that by 2030 the standard of living would be dramatically higher; people, liberated from want (and without the desire to consume for the sake of consumption), would work no more than fifteen hours a week, devoting the rest of their time to leisure and culture. In Revisiting Keynes, leading contemporary economists consider what Keynes got right in his essay—the rise in the standard of living, for example—and what he got wrong—such as a shortened work week and consumer satiation. In so doing, they raise challenging questions about the world economy and contemporary lifestyles in the twenty-first century. Written in 1973 but only recently discovered in a private archive, this work extends Lefebvre’s influential theory of urban space to the question of architecture. Taking the practices and perspective of habitation as his starting place, Lefebvre redefines architecture as a mode of imagination rather than a specialized process or a collection of monuments.
