Book excerpt: Il est traditionnel d'opposer une recherche publique « scientifique » produisant des biens non appropriés à une recherche dite « technologique » ou appliquée, pour une grande part privée, dont les résultats sont protégés par le secret ou par la propriété intellectuelle. Ce modèle est actuellement remis en cause. Avec l'essor de l'économie de la connaissance, la recherche publique est de plus en plus amenée à valoriser économiquement ses travaux et à les protéger par des droits de propriété intellectuelle. Parallèlement, les acteurs privés concurrencent davantage les organismes publics dans la production de connaissances scientifiques et les diffusent parfois librement. Dans ce contexte, la protection par brevet des résultats de la recherche scientifique exerce des menaces sur les missions de la recherche publique, en particulier dans le domaine des biotechnologies. Ces menaces ne sont pas nouvelles. Toutefois, elles sont plus vives qu'auparavant. Elles soulèvent de fortes inquiétudes car les enjeux en cause sont très importants. La préservation d'une « science ouverte » est indispensable pour assurer une allocation suffisante de ressources dans la production de connaissances. Une évolution du droit des brevets concilierait le brevet et le modèle de la « science ouverte ». Elle rendrait le droit des brevets plus cohérent. Elle revaloriserait le brevet. Enfin, elle aiderait à poser les bases d'un droit commun de la propriété intellectuelle tout en préservant et/ou en accentuant le rôle de matrice du Code civil.
