Book excerpt: The Sexual Violence and Impunity in South Asia research project (coordinated by Zubaan and supported by the International Development Research Centre) brings together, for the first time in the region, a vast body of knowledge on this important - yet silenced - subject. Six country volumes (one each on Bangladesh, Nepal, Pakistan, Sri Lanka, and two on India, as well as two standalone volumes) comprising over fifty research papers and two book-length studies, detail the histories of sexual violence and look at the systemic, institutional, societal, individual and community structures that work together to perpetuate impunity for perpetrators. The essays in this volume examine history and contemporary politics to understand the root causes of sexual violence in Sri Lanka. They look at the polarization created around ethnic and linguistic identities during the three-decades of ethnic conflict, but also scrutinize the routine violence of communities towards their own women in daily life. The authors argue that in this transitional post-war phase, Sri Lankan women must not only be treated as victims, but as agents of change. The writers highlight a hitherto unaddressed aspect of sexual violence: that of the structures that enable impunity on the part of perpetrators, be they security personnel and paramilitary forces, members of armed rebel groups, gangs, local politicians and police or ordinary citizens including close family members. They demonstrate how impunity for perpetrators is both a failure of the formal justice process and a product of individual, community and social conditions and indeed the choices that victims and families make that promote silence over truth. At the end of more than a quarter century of conflict that has left some 100,000 dead, 50,000 women-headed households struggling to survive, as well as countless victims and survivors of sexual violence, the calls for justice can no longer be ignored.

It examines the testimonies of victims and witnesses and their reasons for testifying, their attitudes towards perpetrators, the consequences of testifying, their recommendations for other witnesses and conceptions of justice. In addition, it explores the attitudes of judges, prosecutors, psychologists and those in charge of protecting and offering services. As feminists, we were concemed about the treatment of rape victims and the attrition in rape cases under traditional rape law, and we welcomed legal reforms designed to improve the situation. As sodal sdentists, we wondered about the efficacy of legal changes aimed at an inherently resistant court system. We also were curious about the lack of studies examining the impact of these changes; we were particularly surprised to find that no one had attempted to ana lyze the impact of the reforms in more than one jurisdiction. Con vinced that untangling the effects of the reforms from the effects of contextual factors required a multijurisdictional study, we deeided to undertake the project. We quickly discovered that evaluating rape law reform in several jurisdictions would be no easy task. We had deeided that such an evaluation would require monthly data on the outcome of rape cases before and after the reforms were implemented, as weIl as qualitative data on the attitudes of criminal justice officials toward the reforms. Because states do not generate monthly data on case outcomes, we would have to collect the data ourse1ves from court records main tained by individual jurisdictions. To obtain an adequate number of cases for the time-series analysis, we would have to select our sites from large urban jurisdictions scattered throughout the United States.

This book offers a comprehensive analysis of the causes, consequences and responses to sexual violence in contemporary armed conflict. It explores the function and effect of wartime sexual violence and examines the conditions that make women and girls most vulnerable to these acts both before, during and after conflict. Such questions remain largely unanswered. More broadly, the long-term consequences of conflict-related rape and sexual violence are often overlooked. Based on extensive interviews with male and female survivors from all ethnic groups in Bosnia-Herzegovina (BiH), this interdisciplinary book addresses a critical gap in the current literature on rape and sexual violence in conflict situations. In so doing, it uniquely situates and explores the legacy of these crimes within a transitional justice framework. Demonstrating that transitional justice processes in BiH have neglected the long-term effects of rape and sexual violence, it develops and operationalizes a new holistic approach to transitional justice that is based on an expanded conception of ‘legacy’ and has a wider application beyond BiH.

She applies a critical feminist approach to two major conflicts in the Indian subcontinent – the Partition of India in 1947 and the Liberation War of Bangladesh in 1971 – and offers suggestions for addressing historical injustices and war crimes in the context of modern Bangladesh. Addressing how the social and political elites were able to construct and legitimize a history of the state that ignored these issues, the author suggests a critical re-examination of the national narrative of the creation of Bangladesh which takes into account the rise of Islamic rights and their alleged involvement in war crimes. Looking at the impact that notions of nation-state and nationalism have on women from a critical feminist perspective, the book will be an important addition to the literature on gender studies, international relations and South Asian politics.
