Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. It also discusses the possibility of negotiating a sustainability treaty for the Arctic with high standards of environmental protection similar to those in the 1991 Protocol on Environmental Protection to the Antarctic Treaty. It is hoped that this review of the legal and policy contrasts between the Arctic and Antarctic can help in the consideration of future directions for the Arctic legal regime.

Book excerpt: It is frequently hypothesized that environmental management systems (EMSs) may improve a firm's environmental performance. Whether or not this hypothesis is true is as important from the perspective of environmental policy as questions relating to the relevant incentives for (1) a firm's voluntary adoption of an EMS and (2) its environmental innovation behavior. Based on ample empirical evidence for German manufacturing, this paper addresses these issues on the basis of a recursive bivariate probit model that explicitly takes into account that a facility's decision on innovation activities is correlated with the decision on EMS certification. Our empirical results indicate that environmental innovation activities are not associated with EMS certification nor any other single policy instrument. Rather, innovation behavior seems to be correlated to the stringency of environmental policy.

The codification project takes up a transnational legal trend that has already led to the passing of similar legislation in a number of countries such as the Netherlands, Switzerland and the United Kingdom or the preparation of corresponding drafts, as in France, Sweden, Poland and Hungary. The European Union is also looking into the codification of environmental law. The Commission's draft applies the principle of sustainable environmentally sound development and establishes an integrated cross-media approach in all areas of environmental legislation. One of its principal features is the unified project authorisation model (Vorhabengenehmigung) for environmental legislation, which the Federal Government intends to use as a basis for the planned implementation of the IPPC Directive in a first volume of an Environmental Code. Other aims pursued by the Commission were to strengthen the responsibility of enterprises and of society, develop incentive instruments and expand transboundary environmental protection. The draft was prepared between autumn 1992 and summer 1997. The Commission consisted of eight experts with practical experience in the field of environmental law as judges, university teaching staff, lawyers, administrative officials and an environmental officer in a large industrial company. This volume contains the English translation of the draft. It seeks to make a contribution to international and European discussions about the harmonisation and codification of environmental law. For this reason the introduction to the English version also contains observations about the German legal system and existing environmental legislation which should make it easier for the reader to understand the proposals.
