Credit Nation examines how the drive to expand credit shaped property laws and legal institutions in the colonial and founding eras of the republic. In this major new history of early America, Claire Priest describes how the British Parliament departed from the customary ways that English law protected land and inheritance, enacting laws for the colonies that privileged creditors by defining land and slaves as commodities available to satisfy debts. Colonial governments, in turn, created local legal institutions that enabled people to further leverage their assets to obtain credit. Priest shows how loans backed with slaves as property fueled slavery from the colonial era through the Civil War, and that increased access to credit was key to the explosive growth of capitalism in nineteenth-century America. It focuses on changing conceptualizations of ownership and emphasizes the persistent influence of the English common law on Virginia's postcolonial political culture. The book explains how the traditional characteristics of land tenure became subverted by the dynamic contractual relations of a commercial economy and assesses the political consequences of the law reforms that were necessitated by these developments. Nineteenth-century reforms seeking to reconcile the common law with modern commercial practices embraced new democratic expressions about the economic and political power of labor, and thereby encouraged the idea that slavery was an essential element in sustaining republican government in Virginia. By the 1850s, the ownership of human property had replaced the ownership of land as the distinguishing basis for political power, with tragic consequences for the Old Dominion.

Early activists frequently used the word to describe the nation they wished to create through revolution and later reform. The book examines what the Framers of the Constitution meant when they used the term empire and what such self-conscious empire building tells Americans about the underlying goals of their constitutional system. Utilizing the author’s extensive research from colonial times to the turn of the twentieth century, the book concludes that imperial ambition has profoundly influenced American constitutional law, theory and politics. It uses several analytical techniques to ascertain the multiple meanings of such fundamental words as empire and republic and demonstrates that such concepts have at least four levels of meaning. Relying on numerous examples, it further concludes that American leaders frequently (even proudly) used the word with some of its most domineering implications.

According to the standard interpretation, echoed by as lofty an authority as Supreme Court Justice Harry Blackmun, the courts did little in the way of protecting property rights in the early years of our nation. Not only does Siegan find this accepted teaching erroneous, but he finds post-Colonial jurisprudence to be firmly rooted in English common law and the writings of its most revered interpreters. Siegan conducts an exhaustive examination of property rights cases decided by state courts between the time of the ratification of the U.S. Constitution in 1788 and the adoption of the Fourteenth Amendment in 1868. This inventory, which in its sweep captures scores of cases overlooked by previous commentators on the history of property rights, reveals that the protection of these rights is neither a relatively new phenomenon nor a heritage with precarious pedigree. These court cases, as well as early state constitutions, consistently and repeatedly embraced key elements of a property rights jurisprudence, such as protection of the privileges and immunities of citizens, due process of law, equal protection under the law, and prohibitions on the taking of property without just compensation. Case law provides overwhelming evidence that the American legal system, from its inception, has held property rights and their protection in the highest regard.The American Revolution, Siegan reminds us, was fought largely to affirm and protect private property rights-that is, to uphold the "rights of Englishmen"-even if it meant that the colonists would cease being Englishmen. John Locke and other great theoreticians of property rights understood their importance, not only to individuals who happened to possess property, but to the preservation of a free society and to the prosperity of its inhabitants. Siegan's contribution to this venerable tradition lies in his faithful reconstruction of our legal history, which allows us to see just how central property rights have been to the American experiment in liberty-from the very beginning.
