Book excerpt: Ante el entorno de restricción fiscal que enfrenta la mayoría de los países de la región, las autoridades ambientales ven limitadas las posibilidades de fortalecer su capacidad mediante mayores asignaciones presupuestarias. Se impone la necesidad de mejorar la calidad ambiental al menor costo económico posible y aumenta la percepción de que los esquemas regulatorios tradicionales no han logrado responder adecuadamente a los procesos de deterioro de la calidad ambiental que aquejan a la región. Este proyecto propone: a) evaluar las lecciones extraídas de los casos de aplicación de instrumentos económicos que se han dado en los países de la región y b) en base a la evaluación de las circunstancias locales en que deben operar estos instrumentos, desarrollar recomendaciones propositivas que le sirvan a los gobiernos en el futuro diseño y aplicación exitosa de dichos instrumentos en apoyo a sus políticas de gestión ambiental.

Book excerpt: El desarrollo y la puesta en marcha de las políticas ambientales, así como de las competencias que corresponden a las autoridades ambientales por mandato legal, requiere la asignación de fondos suficientes que permitan gestionar de manera eficiente el uso, aprovechamiento, conservación y protección de los recursos naturales del país. De igual manera, el avance de la economía y de los sectores productivos depende no solo del máximo aprovechamiento de los recursos naturales sino también de la garantía de su restitución y sustitución, y del respeto por la capacidad de resiliencia de los elementos de la naturaleza. Igualmente, la generación de valor por la empresa se ve reflejada no solo en los balances financieros sino también en su capacidad de hacerlo a través de prácticas ambientalmente sostenibles". En un momento como el actual, en el que las presiones económicas son generadas por variados factores y cuando la comunidad internacional ha reconocido a la economía verde como un instrumento para alcanzar el desarrollo sostenible (ONU, 2012), es necesario analizar la forma de mejorar el bienestar humano, fomentar la igualdad social y reducir los riegos ambientales mediante el uso eficiente de los recursos. En razón a la importancia del tema, el Grupo de Investigación en Derecho del Medio Ambiente de la Universidad Externado de Colombia decidió desarrollar el Proyecto "Instrumentos económicos y financieros para la gestión ambiental", a fin de estudiar la mejor forma de suscitar la asignación y el uso eficiente de los recursos naturales, buscando que sea el mercado el que promueva cambios en el comportamiento de los agentes, ya sea por medio de ventajas, ayudas o incentivos, para favorecer comportamientos favorables o por medio de obstáculos o cargas que desincentiven comportamientos ambientalmente no deseables. De otro lado, se analiza la forma como los instrumentos financieros permiten recaudar recursos para financiar actividades operativas y de inversión propias de la gestión ambiental, incluyendo aquellos calificados como fiscales o tributarios. El estudio se estructuró en tres partes: en la primera se analizan los instrumentos económicos y financieros en el derecho extranjero; en la segunda se examinan algunas de las rentas de las Corporaciones Autónomas Regionales -CAR- identificadas en la Ley 99 de 1993, y la tercera se destina al estudio de otros instrumentos útiles para el desarrollo de una economía verde.

Book excerpt: When taxes are introduced on carbon and energy, and the revenue is used to reduce other taxes, will a positive effect be achieved both for the environment and for the economy? In 1990 Finland was the first country to introduce a tax on CO2. Later, Sweden, Denmark, Netherlands, Slovenia, Germany and the UK followed suit with tax reforms that shifted taxation from labour to carbon and energy. Over the years, CO2 and energy taxes have gradually been raised, so that in Europe taxes of more than 25 billion Euros a year have been shifted. This book examines carbon-energy taxation in detail and looks at tax shifting programmes for lowering other taxes. It offers extensive analysis on the basis of historical data and seeks to answer important questions for policy-making, such as: What was the impact of tax shifting for economic performance and competitiveness? By how much were emissions of CO2 reduced? Could energy-intensive industries cut further down on their fuel demand or did they loose market shares? To what extent was there 'leakage' from Europe, so that production and CO2 emissions were shifted to other countries or regions without CO2-abatement policy? The use of unique and original data, including sector-specific energy prices and taxes, as well as the use of advanced statistical techniques, such as co-integration analysis and panel-regression techniques along with the time-series estimated macro-economic model E3ME, make this a truly comprehensive volume. On the basis of the lessons learned in Europe, this volume indicates how carbon-energy taxation could usefully be combined with emissions trading, and discusses implications for future international climate policy, including how the IPCC recommendations for a gradual escalation in carbon price could be accomplished while preventing carbon leakage.

Book excerpt: Payments for Environmental Services (PES) are being considered worldwide with great interest and expectation. Proposals to create agreements in which beneficiaries of environmental services pay landowners directly for the provision or protection of these services are innovative and promising. But what real PES experiences are actually out there? This work assesses a range of PES or PES-type experiences in one country, Bolivia, in the fields of carbon sequestration, protection of watershed services, biodiversity and aesthetic landscape values. The report concludes that while none of the generally young initiatives adhere fully to the principle of PES as developed in the theoretical literature, many experiment with some of the relevant PES mechanisms. Protection of watersheds and landscape values are the most common types, though the implementing intermediaries often have underlying biodiversity-protection goals. Main obstacles to PES implementation include ideological resistance against the PES concept, the difficulty of building trust between buyers and sellers, and limited willingness to pay on behalf of service users. During their relatively short lifetime, basically all initiatives had been successful in making service sellers (PES recipients) better off in economic terms, while the effectiveness in achieving environmental objectives and securing positive social impacts so far remained more variable. In some cases, redesigning these initiatives to bring them closer to the full PES principles could also enable them to more effectively achieve positive environmental and livelihood outcomes.
