Book excerpt: More than forty years have passed since President Richard Nixon described illegal drugs as “public enemy number one” and declared a “War on Drugs.” Recently the United Nations Global Commission on Drug Policy declared that “the global war on drugs has failed with devastating consequences for individuals and societies around the world.” Arguably, no other country has suffered as much from the War on Drugs as Mexico. From 2006 to 2012 alone, at least sixty thousand people have died. Some experts have said that the actual number is more than one hundred thousand. Because the war was conceived and structured by US policymakers and officials, many commentators believe that the United States is deeply implicated in the bloodshed. A War that Can’t Be Won is the first book to include contributions from scholars on both sides of the US–Mexico border. It provides a unique breadth of perspective on the many dimensions of the societal crisis that affects residents of both nations—particularly those who live and work in the borderlands. Is it possible to exclude such people in the name of freedom and reason? Is it plausible to explain classifications that differentiate between first- and second-class citizens as “natural”? This is the paradox inherent in modern politics, born of the revolutions that ended the Ancien Régime in the western world. Throughout the nineteenth century and at the beginning of the twentieth, liberalism inspired a representative form of government that appealed to citizenship, yet marginalized many social groups, including natives, women, immigrants, workers, slaves and nomads. In the Hispanic dimension of the Atlantic world that this book deals with, modern politics was based on exclusions explained as natural and necessary. In both Europe and America, a distinction was made between the responsible citizen and those “others” in society, potential “enemies within”, who had to be controlled and supervised. This book explains the success of this political operation by analysing the historical construction of figures of alterity that were fundamental to the definition of national civic identities. Its basic premise is that imaginaries that were constructed in the nineteenth century can be found even today in western political conceptions. The cultural complexity of enduring political images is revealed by exploring the inner workings of virtuous figures in relation to their opposites: readers will find the mosaic of representations of civic alterity both recognisable and surprising. The contributors to this volume provide historical perspectives on the debate on political legitimacy in open societies. Reinventing democracies involves understanding the historicity of inherited formulae of governance and considering them, therefore, as amenable to improvement. The readiness to do this is not a threat to democracy but, rather, a commitment to looking for it.

Those objectives were considered by the Study Group about History of Prison and Punitive Institutions (Grupo de Estudio sobre la Historia de la Prisión y las Instituciones Punitivas, GEHPIP) –an interuniversity team and with central office at Universidad de Castilla-La Mancha (UCLM)– when organising what it decided to name in an homonymous way 1st International Congress on History of Prison and Punitive Institutions (I Congreso Internacional sobre Historia de la Prisión y las Instituciones Punitivas), held in Ciudad Real (Spain) from 10 to 12 April 2013. As well as reflecting the diversity of legisprudence as a re-emerging academic field, it offers a broad overview of current developments and challenges in the theory of legislation, and aspires, moreover, to counterbalance some questionable ideas or misconceptions, widespread among jurists, on what making laws entails. The book is organized into three parts. The first comprises a sample of ‘ways and models of legislation’, ranging from classic legislative ideals to contemporary forms of regulation. The essays in this part, variances of focus notwithstanding, revolve around the notions of legislative rationality, quality, effectiveness, and legitimacy, which may be regarded as the cornerstones of legisprudence. Interwoven with these notions is another core legisprudential concern: the justification of laws. We address it separately in the next part by exploring the connection between lawmaking, argumentation and constitutional democracy: under the heading ‘legislation in a culture of justification’, a number of aspects of this connection are tackled that have not been sufficiently considered so far in legisprudential literature, such as the intricacies of legislative reasoning and balancing, or the justificatory problems posed by special-interest legislation. The under privileged status of legisprudence in legal studies and the need for socially attentive and citizen-oriented legislative research come to the fore in the third part of the book which turns to the relationships between ‘legisprudence, lawyers, and citizens’. All in all, the thirteen articles gathered here provide a stimulating insight into the theory of legislation, and can hopefully contribute to the reconciliation of the study of law and the study of its making.
