Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Handy Book on the Practice and Procedure: Before the Judicial Committee of Her Majesty's Most Honourable Privy Council One of the chief objects of the writer in compiling this handbook is to afford a guide to professional gentlemen practising in the superior Courts throughout India, from which. An appeal is allowed to the Privy Council, in cases in which they have to send appeals to England; but at the same time the writer wishes to point out, that as the procedure is the same in all cases, whether the appeal be from India or from any other of Her Majesty's colonies or dominions, this book will be of equal assistance to those practising in any colony or dependency other than India, from which an appeal lies to the Privy Council. Book Islamic Law in the Indian Ocean World

Download or read book Islamic Law in the Indian Ocean World written by Mahmood Kooria and published by Routledge. This book was released on 2021-09-23 with total page 197 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the ways in which Muslim communities across the Indian Ocean world produced and shaped Islamic law and its texts, ideas and practices in their local, regional, imperial, national and transregional contexts. With a focus on the production and transmission of Islamic law in the Indian Ocean, the chapters in this book draw from and add to recent discourses on the legal histories and anthropologies of the Indian Ocean rim as well as to the conversations on global Islamic circulations. By doing so, this book argues for the importance of Islamic legal thoughts and practices of the so-called "peripheries" to the core and kernel of Islamic traditions and the urgency of addressing their long-existing role in the making of the historical and human experience of the religion. Islamic law was and is not merely brought to, but also produced in the Indian Ocean world through constant and critical engagements. The book takes a long-term and transregional perspective for a better understanding of the ways in which the oceanic Muslims have historically developed their religious, juridical and intellectual traditions and continue to shape their lives within the frameworks of their religion. Transregional and transdisciplinary in its approach, this book will be of interest to scholars of Islamic Studies, Indian Ocean Studies, Legal History and Legal Anthropology, Area Studies of South and Southeast Asia and East Africa.

Book The Judicial Committee and the British North America Act

Download or read book The Judicial Committee and the British North America Act written by G.P. Browne and published by University of Toronto Press. This book was released on 1967-12-15 with total page 264 pages. Available in PDF, EPUB and Kindle. Book excerpt: This comprehensive study is concerned primarily with the fundamental problem of the role of the judiciary in the federal system of Canadian government. The author criticizes previous accounts of the Judicial Committee’s interpretative scheme for the British North American Act because of their neglect of underlying jurisprudential assumptions and their readiness to accept the textual criticisms levelled in the O’Connor Report of 1939; they fail to note the relationship between the jurisprudential and the textual aspects. Professor Browne is convinced that O’Connor’s criticism is as ill founded as the alternative interpretive scheme he proposed, and that the “three-compartment” view represents the most convincing construction of sections 91 and 92 of the Act. He considers debatable the “organic statute” argument widely accepted in the United States and becoming more and more popular in Canada; and supports the premium which English courts have traditionally placed on certainty and stability in the law. Professor Browne concludes that the almost universal criticism in Canada of the Judicial Committee’s construction of the BNA Act is basically misconceived: Canadian jurists should think carefully before following trends set by American courts, for American purposes, in the context of American law, particularly when the repercussions of those trends are not as yet fully appreciated. This discussion will be of special interest for legal, political, and historical studies in this country, the United States, and other Commonwealth countries, especially those which have federal systems and consequently share the same basic problems of the judiciary in such a system.
