This has precipitated a serious overcrowding problem with federal and state prisons currently operating well beyond capacity. Conventional efforts appear unable to cope with the increasing shortage of beds or with inadequate rehabilitation services. A bold solution is required; increasingly it is being seen to reside in the private sector. This timely volume explores the issues of private versus public financing, construction, and management of medium-and high-security prisons. Private prisons are not a new concept in the United States. They have existed in several forms since the eighteenth century. The opening chapters evaluate historical cases of prisons for profit, examining the concerns of labor, abuses of inmates, and the source and resolution of disputes between private and public sectors. These chapters argue that the experience gained through privatization does not justify current opposition from civil libertarians or labor unions. Chapters dealing with the modern contracting out of complete management and limited services document the growing trend toward privatization and instances of public/private partnership in prison industries. The assembled evidence indicates clearly that privately run prisons have shown significant cost savings and good quality of provision for prisoners while still being profitable. However, the authors caution that these promising results must be reinforced by public safeguards in the contracting stage and monitoring to assure good service and security. With the American prison system in disarray, the public interest demands that government look beyond the public or private identity of those who wish to provide correctional services and focus instead on who can provide the best services at a given cost. It is essential to state that correctional services should attain several objectives and not merely cost minimization. The analysis and recommendations presented here will aid in the task. Book excerpt: Armstrong studies the environmental quality of confinement in private and public juvenile correctional facilities using data from 48 facilities, representing 4,590 delinquents, 1,362 staff, and 48 administrators in 19 states (16 private and 32 public facilities). Her results demonstrate that neither staff nor juvenile delinquents perceived the environmental quality to be significantly different between private and public facilities. Further, compared to public facilities, private facilities were smaller, newer and had a more intensive admission process for juvenile delinquents. Public and Private correctional staff differed significantly on age and prior work experience. Differences in the juvenile populations were minimal.

Book excerpt: This report discusses the findings of a nationwide study on the use of private prisons in the United States. The number of these prisons grew enormously between 1987 and 1998, with proponents suggesting that allowing facilities to be operated by the private sector could result in cost reductions of 20%. The study examined the historical factors that gave rise to the higher incarceration rates, fueling the privatization movement, and the role played by the private sector in the prison system. It outlines the arguments, both in support of and opposition to, privatized prisons, reviews current literature on the subject, and examines issues that will have an impact on future privatizations. The report concludes that, rather than the projected 20-percent savings, the average saving from privatization was only about 1 percent, and most of that was achieved through lower labor costs. Nevertheless, there were indications that the mere prospect of privatization had a positive effect on prison administration, making it more responsive to reform.

As the number of adolescents who interact with the justice system grows, these needs will only intensify. Many adolescent offenders enter juvenile detention facilities with histories of trauma, undiagnosed mental illness, and a profusion of other concerns that would necessitate the assistance of mental health professionals. The experience of living in a detention facility can be daunting as well, with many juveniles reporting instances of trauma, including violence and sexual abuse. With so many challenges to face, the mental health treatment of adolescents in detention facilities is of the utmost importance. However, many reports indicate that the quality and quantity of mental health offerings in these settings is not meeting the need. In this research study, five juvenile offenders who have each spent more than three months in a juvenile detention center, and have had interactions with the mental health treatment system in the facility, were interviewed. Based on their lived experiences, more information about the perceptions of juvenile offenders regarding life in juvenile detention facilities, and the mental health treatment being given there, was determined and analyzed. Despite varying reports regarding the availability and quality of the mental health treatment offered in these detention centers, many of the participants found the experience transformative and life-altering. The participants provided in-depth reports of their daily challenges, emotions regarding incarceration, and their interactions with staff and mental health treatment. The lived experiences of these participants varied, but a number of thematic concepts were identified and investigated based on their accounts.

The privatization created massive change, and at this agency the change created results that differed from the dire negative images found in the literature. One explanation for these positive outcome was the use of an organizational analogue of Psychiatric Rehabilitation, a practice developed by William Anthony, from Boston University's Center for Psychiatric Rehabilitation, to help people cope with change. At this nonprofit, the PR analogue was used to assess the agency's readiness to change, providing a useful framework for understanding what occurred during and after privatization. Managing is difficult in any environment but in one of shrinking funds, increased risks of litigation and increasing oversight, leaders can lose their vision and their way. If we choose to manage, we have a responsibility to assure that agencies have the resources needed to provide for those who are most at risk but who like every other member of society deserve a chance to lead productive and satisfying lives. Finding innovative ways through the turbulence of change will insure the continuance of nonprofits and assure that the vision of recovery remains foremost on the agenda of mental health agencies now and in the future.
