Book excerpt: The history of United Nations peacekeeping is largely one of failure. The causes are endemic, persistent and unlikely to be remedied. It seems reasonable to consider two ideas in response: whether ad hoc peacekeepers might be augmented or even replaced by competent contract labour; and whether well-trained contractors might in future subdue by force those who inflict gross human rights abuses on others. Alternatives to ad hoc forces are not new. Nevertheless, theoretical or practical substitutes have not been evaluated alongside the merits of a private corporation. Military contractors are frequently misrepresented as an affront to states' authority. This is misleading. There has never been a clear divide between public and private resources in armed conflict and states have always employed both. There exists no compelling reason why the UN should not devise modern contracts that evolve from historically ubiquitous arrangements amongst its members and their more ancient predecessors.

[...] By this I mean to say, that the proposal to em/deploy PMFs on and for UN peace operations represents a significant challenge to notions of state or public-sector delivered and guaranteed security and thus the emergence of this proposal can be seen as a pertinent opportunity to pursue an interrogation of UN peace operations more generally. [...] Moreover, as the proposal to contract PMFs to conduct UN peace operations signals the increasing, though not unexpected, incursion of the private (for profit) sector into the deliverance of 'public security', it is imperative that the privatizing peace literatures better understand and address the problematic intersections of problem-solving methodologies, (neo)colonialism, militarization, and neo [...] Similarly, "Arms procurement and brokering of small arms and light weapons (SALW) are integral aspects of the activities of mercenaries, private military companies and private security companies" and thus the intervention of PMFs can result in the further channeling or trafficking of arms into conflict zones (Makki et al. [...] Likewise, exclusive focus on the pros and cons raised by and in the privatizing peace literatures comes at the expense of an analysis of the problematic elisions and obfuscations that the privatizing peace literatures can be seen to make.

The extensive outsourcing of military and security activities has challenged conventional conceptions of the state as the primary holder of coercive power and raised concerns about the reduction in state control over the use of violence. Hannah Tonkin critically analyses the international obligations on three key states - the hiring state, the home state and the host state of a PMSC - and identifies the circumstances in which PMSC misconduct may give rise to state responsibility. This analysis will facilitate the assessment of state responsibility in cases of PMSC misconduct and set standards to guide states in developing their domestic laws and policies on private security.

Book excerpt: This book investigates the connection between tightening mobilization constraints and the use of PMSCs in the United States, the United Kingdom, and Italy. Drawing on neoclassical realism and institutionalist theory, it conceptualizes democracies’ use of private military and security companies (PMSCs) as an attempt to circumvent the tightening constraints on the mobilization of military power. The use of private military contractors is less subjected to parliamentary restrictions and less visible to public opinion than the deployment of soldiers. Rather than cheaper in financial terms, PMSCs are therefore politically cost-effective, as they enable decision-makers to minimize the institutional obstacles on conducting military operations and the electoral costs attached thereto. The need to reduce the ex ante hurdles and the ex post costs of military deployments fills the blind spots of alternative explanations for the use of PMSCs based on effectiveness, ideology, and organizational interests.

Book excerpt: The aim of this study is to fill a significant gap in the existing literature on the role of non-state actors, ranging from rebels and criminal gangs at one extreme to the corporate security industry at the other. As part of the general privatisation of the security sector in the western world, combined with the US-led war on terror, non-state actors have increasingly been tied to the foreign policy priorities of the dominant western military powers. Iraq and Afghanistan are the examples often used, and are well-described in other chapters in this book. In sub-Saharan Africa, as in many fragile states around the world, this picture is blurred, and it is often difficult to make clear distinctions between public and private, or between illegal and legal etc., (non)-state actors.
According to much of the academic literature, the nature of war changed dramatically in the last part of the twentieth century, especially after the end of the Cold War. According to this logic there is a dichotomy between war as a social phenomenon and warfare as the domain of the state, as envisaged by the late Prussian military theorist, Carl von Clausewitz, in the shape of the “Trinitarian War”. The lack of capacity on the part of predominately Third World states to control conflicts has led to low-intensity conflicts (LIC), which can be witnessed, for instance, in Uganda, the Democratic Republic of Congo, Colombia and Sri Lanka. Since the end of the Cold War it has been common for weak state rulers with formal state legitimacy but not empirical legitimacy to have continued to enjoy international recognition because of international fears that they are the only barrier against a total collapse. Amongst other things this paved the way for an expansion of the market for private military and security companies (PMSC) such as the South African-based Executive Outcomes (EO) in the 1990s. However, the lack of state capacity led to a sub-contracting, willingly or unwillingly, of the state’s monopoly on the use of force to non-state actors, PMSCs and semi-state actors, like local militias, warlords, criminal gangs and vigilant groups, in an attempt to secure weak state leaders’ positions. In the competition for state control internationally recognised leaders have an advantage over their non-state rivals because they can seek military help outside their countries with the agreement of the international community and in accordance with international law.
