As the first major content industry to have its production and distribution patterns radically disturbed by the internet, the recording industry’s content, attitudes and practices have regularly been under the microscope. However, the problem remains that creators are often not fairly remunerated for the online use of their works. This book addresses the urgent need to study pragmatic legal solutions that enable Internet users to access works in the digital environment, while assuring remuneration to rights holders and promoting the development of the information society. This study examines legalisation schemes that favour remunerated access over exclusivity and enforcement for large-scale online use by individuals. It investigates whether and to what extent these schemes (referred to as alternative compensation systems) are admissible under EU copyright law and consistent with its objectives, responding to such questions as the following in depth: - What existing copyright schemes provide an alternative to the exclusive right in copyright law? - What online rights apply to the activities of Internet users? - What types of models exist for the legalisation of online use of copyright works? - How can the public interest shape the scope of protection of copyright? - Can and should we legalise non-commercial file sharing and online use in EU copyright law? Book excerpt: Many owners of intellectual property have recently claimed substantial economic losses due to unauthorized copying made possible by new technologies. Most of these claims are based on inadequate data or erroneous assumptions. Most studies of the extent of the harm fail to compare the behavior of consumers and producers before and after copying is introduced and, in particular, to describe the likely effect of copying on the prices charged for originals. This report develops a general economic model of private copying. The analysis focuses on the nature of private copying costs and considers the extent to which consumers use copies as substitutes for originals, and it shows how some previous analyses are special cases of this general model. It then applies the model to the problem of determining the royalties to be charged for making copies. The analysis makes clear that the effects of private copying on producer and consumer welfare differ considerably depending on the assumptions made regarding the substitutability of copies for originals, and the relative costs of producing copies and originals.

Book excerpt: Copyright is not, as is often thought, something that is periodically ‘extended’ to cover a new field or medium; rather, copyright redefines itself whenever its efficacy is challenged. While many factors have contributed to this process, the most consistent has been the challenges created by new technologies. The contributing authors build upon this insight to show that copyright law is, and has always been, a creature of technology. Each chapter focuses on a specific technology or group of technologies – photography, telegraphy, the phonogram, radio, film, the photocopier, the tape player, television, and computer programs – emphasizing the changes that each technology instigated and the challenges and opportunities it created. Perhaps the most profound insight of this extraordinary book is the authors’ claim – ably supported in a series of intriguing chapters – that the way the law responds and reacts to new technologies is always mediated by the political, social, economic, and cultural environment in which the interaction occurs. For example, these chapters describe and explain how: statutory schemes of remuneration arose from failures to effectively police new forms of piracy; persistent litigation and lobbying by copyright owners forces legislatures and courts to devise new laws; content (e.g., sporting events) generates new rules of access to broadcasts; and ‘fair copying’ (e.g., by libraries) is the necessary exception that proves the rule. As well as providing insight into the ways that copyright law interacted with old technologies when they were new, the book also offers important insights into problems and issues currently confronting copyright law and policy such as the appropriate scope of copyright and the relation between copyright and the public interest.
