Book excerpt: What this book intends to do is to study three-dimensionalism (the distinction values-norms-facts) not in what could be called its historical dimension, but in its substantive aspect, as a “form” that, when applied to different legal themes, would add a “material content” to the three-dimensional theory. We can point out, as a study plan, the distinction between “three” perspectives: Those of the legal norm, of the legal order, and the legal relationship. Three-dimensionalism also appears in this work when one analyzes the “three” phases of the life of the law: The formation, the interpretation, and the application; and in the distinction between the “three” characteristics of the legal order: Fullness, coherence, and unity—the theory of legal validity, intended as legitimacy, as validity strictly speaking, or as effectiveness.

So wurden Themen behandelt wie die Zusammenhänge zwischen der phänomenologischen materialen Wertethik und der Idee des Naturrechts, die Unterscheidung zwischen der sittlichen und der rechtlichen Sphäre, die Kritik an denjenigen Theorien, die die Menschenrechte im Naturrecht verorten, die Motive, die uns dazu veranlassen, gewisse Tatsachen und Pflichten als Folgen sozialer Akte zu betrachten, der Sinn des Wortes „Freiheit“ im Rahmen des Strafrechts oder die kritische Prüfung derjenigen Auffassungen, die die Rechtsphilosophie auf eine Reihe von psychologischer, sozialer bzw. historischer Fragen zu reduzieren versuchen, wenn sie in Wahrheit auf einer Diskussion über Grundsatzfragen und nicht auf reiner Tatsachenüberprüfung beruht. Trotz ihrer Vielfalt haben alle Beiträge zwei Aspekte gemeinsam: einerseits teilen sie die Überzeugung der Notwendigkeit eines Dialogs zwischen so verschiedenen Disziplinen wie der Philosophie und dem Recht, um die zentrale Frage nach dem Bestehen von vor-positiven Elementen des Rechts aufzuklären, die jeder positiven Gesetzgebung vorangehen; andererseits sind sie der Überzeugung, dass solche Elemente ihre eigene Verständlichkeit haben. This volume contains the proceedings of a conference organized in May 2015 by the Instituto Cultura y Sociedad (University of Navarra). The scope of this conference was very wide as is proved by the variety of the contributions. They deal with such topics as the relationships between material value ethics and the idea of natural law, the distinction between the moral sphere and the sphere of law, the criticisms of those theories which ground human rights in natural law, the motives which lead us to consider certain facts and duties as consequences of social acts, the meaning of “freedom” in criminal law or the critical exam of such views which try to reduce the Philosophy of Law to some psychological, social or historical questions. However, despite their diversity, the contributions share two elements: on the one hand, the emphasis of the necessity of a dialogue between such different disciplines as Philosophy and Law focusing on a central question, namely, the existence of pre-positive elements, prior to every positive legislation and, on the other hand, the conviction that such elements have an own intelligibility.

The book examines the topic not only in North America and western Europe, with essays on Italy, Germany, France, Spain, the United Kingdom, Belgium, and Finland but also the reception and implementation of positivist ideas in Brazil. In doing so, it explores three comparative elements: (1) the differing national experiences within the civil law world; (2) differences and similarities between civil law and common law regimes; and (3) some differences between the two leading common-law countries. It interrogates many key aspects of current penal systems, such as the impact of extra-legal scientific knowledge on criminal law, preventive detention, the ‘dual-track’ system with both traditional punishment and novel measures of security, the assessment of offenders’ dangerousness, juvenile justice, and the indeterminate sentence. As a result, this study contributes to a critical understanding of some inherent contradictions characterizing criminal justice in contemporary western societies. Written in a straight-forward and direct manner, this volume will be of great interest to academics and students researching historical criminology, philosophy, political science, and legal history.

Esta visión, auspiciada por los partidarios de la Contrarrevolución, posteriormente se ha hecho canónica al asentarse los principios proclamados por los revolucionarios franceses. Con la perspectiva de esta visión sesgada, los escritos referentes a la religión se ven como añadidos discordantes, explicándose por causas subjetivas los que se presentan como disarmonías. Frente a esta interpretación, la que el autor propone atiende a aspectos culturales, antes que a aspectos subjetivos. Rousseau es fruto de un momento de transición. Frente al XVIII como el siglo de la razón, el pueblo es eminentemente religioso. La opción de Rousseau por el sentimiento religioso es una opción epistemológica pero a su vez es una opción social, una opción por el pueblo llano, frente a la razón auspiciada por la élite. Rousseau propone una revolución moral presidida por esquemas religiosos, aunque esta religión tiene que adaptarse a los nuevos tiempos: la metafísica debe ceder ante lo terrenal, o la moral primar frente a lo teológico. La religión civil, como religión patriótica, es expresión de su deísmo en el ámbito político.
