Book excerpt: "Desde la imputación formulada se incorpora al proceso penal el objeto de la litis, donde la defensa podrá ejercer su facultad de contradicción, así como el juzgador de resolver desde el criterio de la exigencia. En efecto, el operador puede exigirle al fiscal que explique de manera clara y precisa los cargos que le han formulado al imputado en el marco de una audiencia de tutela de derechos. También, el juez puede exigir al Ministerio Público los elementos de convicción que sustentan el cuadro fáctico imputativo, por ejemplo, en la audiencia de prisión preventiva. Además, el juzgador puede exigir que el fiscal aclare si hay una modificación en su clasificación jurídica en la audiencia de juicio oral para efecto que proceda a formular la acusación complementaria correspondiente. Pero, porque el operador exige no significa la afectación al debido proceso, sino es la consecuencia de amparar la petición justificada de la defensa planteada en el marco del ejercicio de su actividad contradictoria y para no colocar al imputado en un estado de indefensión. En esa inteligencia, la manera cómo se cumpla con los principios de imputación y contradicción apreciaremos el desarrollo del proceso penal y la intervención de los sujetos procesales. Sin embargo, el operador no debe tolerar la imputación indeterminada, expresada en la simple mención de las leyes y sus articulados sin conexión alguna a un cuadro fáctico y a sus elementos de convicción; tampoco se tolera la imputación por la sola razón de ejercer un cargo o rol, sin la explicación a través de las circunstancias de tiempo, lugar y modo de la infracción de un deber jurídico que a su vez actualiza un tipo penal. No obstante, tampoco el operador puede tolerar precisiones abusivas de la defensa, que rompe con la logicidad de la responsabilidad penal. En suma, el principio de imputación constituye la base filosófica del sistema de justicia penal, constructo que, por las razones explicadas en la obra, hemos podido denominar: la pragmática de la imputación penal y que invitamos al lector a su análisis y reflexión para efecto de lograr la coherencia propia de un sistema como es la que se procura con la justicia punitiva". Book excerpt: In this report, the author summarizes her letters to government officials in 44 countries and the Gaza Strip regarding alleged human rights violations committed against judges and lawyers. The author also summarizes the responses of 18 governments to these letters. These cases were reported to her from 16 March 2010 to 15 March 2011. Cases are organized by country. The main areas of concern were threats to lawyers, including acts of interference in the discharge of their professional functions (28%). Issues relating to the fairness of judicial proceedings which include the right to be informed of the charges and undue delays in judicial proceedings, amount to 21% of the cases. In about 14% of the communications, a lack of access to a lawyer is alleged, often observed in places of detention. There were concerns on the independence of the judiciary in about 10% of the cases, in particular interference in the judicial functions and threats to lawyers and prosecutors. Lawsuits against lawyers relating to civil, criminal and disciplinary charges constitute 7% of the cases. 6% concern allegations relating to the lack of access to courts. Cases which raise issues regarding impunity amount to 5% of the communications. 4% of the cases relate to military courts trying civilians, and the same percentage concerns restriction on the freedom of expression of lawyers. Finally, 10% cover other issues, such as freedom of expression of lawyers, impunity, access to a lawyer in private, tenure, removal and appointment of judges, and disbarment of lawyers.

Book excerpt: La presente obra busca plantear una filosofía del sistema penal, la cual descansa en el principio de imputación y a lo que hemos denominado la pragmática de la imputación penal. En esa inteligencia, y recurriendo a la legislación comparada, hemos explicado que la litis se fija cuando se formula imputación o se formaliza la investigación y no al cierre de la investigación cuando se plantea la acusación; ello por mandato legal y por la siguiente lógica del sistema: la afectación de la libertad personal mediante medidas cautelares o el dictado de decisiones jurisdiccionales de terminación o conclusión anticipada del proceso, exigen de una imputación formulada, a la que incluso la futura acusación, juicio y sentencia están vinculados, a saber, al cuadro fáctico imputado; ello, lo hemos explicado en el capítulo primero a través delo que hemos denominado modelo imputativo.Ahora bien, lo que se imputa es un cuadro fáctico y su perfeccionamiento no lo otorga la actual sobrevaloración de los testimonios, sino el recurso a las ciencias forenses (artículo 228° de la norma adjetiva mexicana, artículo 276° de la ley procesal panameña o el artículo 321.2° del Código procesal penal peruano, como ejemplos que la lectura forense, criminalístico y científico de los hechos es la exigencia legal y no una psicología del testimonio); a ello, nos dedicamos en los capítulos segundo y tercero, que por su importancia radica el centro de nuestro estudio. No obstante, el mencionado perfeccionamiento de los hechos nos debe conducir a la afirmación que una persona ha infringido un deber jurídico penal que actualiza tanto la afectación de un bien jurídico legalmente protegido así como un tipo penal; ello nos permite revisar las reglas de imputación objetiva y subjetiva, así como demás categorías de la teoría del delito, pero alejándonos de constructos como la semántica del Derecho penal, la cual no presenta una equivalente potencia con las ciencias forenses; y a ello nos hemos centrado en el capítulo cuarto. Sin embargo, el principio de imputación conlleva a analizar sus consecuencias, como la sanción, la reparación civil y las consecuencias accesorias de las personas jurídicas, conforme lo desarrollado en el capítulo quinto. Finalmente, la imputación requiere de control judicial en audiencia, en razón a los efectos que en los derechos humanos del procesado va a generar, y a ello nos dedicamos en los capítulos sexto y sétimo, con especial referencia a la audiencia inicial regulada en codificaciones como la mexicana; en suma, la imputación es el puente que permite el diálogo entre el Derecho penal y el procesal penal, y a los que nos conducirá a una pragmática (no en su sentido semántico), sino forense, de la imputación.

Lying has been with us from time immemorial. Yet today is different-and in many respects worse. All over the world, people are circulating damaging lies, and these falsehoods are amplified as never before through powerful social media platforms that reach billions. Liars are saying that COVID-19 is a hoax. They are claiming that vaccines cause autism. They are lying about public officials and about people who aspire to high office. They are lying about their friends and neighbors. They are trying to sell products on the basis of untruths. Unfriendly governments, including Russia, are circulating lies in order to destabilize other nations, including the United Kingdom and the United States. In the face of those problems, the renowned legal scholar Cass Sunstein probes the fundamental question of how we can deter lies while also protecting freedom of speech. To be sure, we cannot eliminate lying, nor should we try to do so. Sunstein shows why free societies must generally allow falsehoods and lies, which cannot and should not be excised from democratic debate. A main reason is that we cannot trust governments to make unbiased judgments about what counts as "fake news." However, governments should have the power to regulate specific kinds of falsehoods: those that genuinely endanger health, safety, and the capacity of the public to govern itself. Sunstein also suggests that private institutions, such as Facebook and Twitter, have a great deal of room to stop the spread of falsehoods, and they should be exercising their authority far more than they are now doing. As Sunstein contends, we are allowing far too many lies, including those that both threaten public health and undermine the foundations of democracy itself.
