Book excerpt: Emprunté au domaine de la philosophie morale, la dignité a fait l'objet d'une inscription dans les textes juridiques, notamment internationaux, à la suite de la Shoah. Ainsi, aujourd'hui, le principe de dignité humaine préoccupe aussi bien les juristes que de nombreux publics allant des représentants de multiples disciplines aux simples citoyens en passant par les politiques. En effet, le contenu de ce concept reste indéterminé. Mais peut-il en être autrement sachant que la dignité humaine pose une question centrale : qu'est-ce qui fait la valeur de l'existence humaine ? Dans ce contexte, cet ouvrage tente de relever un défi : analyser les applications du principe de dignité dans vingt pays représentatifs de cultures différentes pour tenter de cerner son contenu et surtout d'apprécier son utilité en droit. Ainsi, à partir de l'examen des lois, des avis de commissions nationales d'éthique ou relatives aux droit de l'homme, mais aussi et surtout des décisions judiciaires, les usages de la dignité sont analysés en vue de faire émerger les lignes de convergence et de divergence. L'ouvrage fait aussi une place à la perception de la dignité par les Cours européenne et interaméricaine des droits de l'homme ainsi qu'aux regards du philosophe, du sociologue et de l'anthropologue sur les réalités de la dignité. A défaut de progresser sur la définition de la dignité, cette étude permet d'identifier la finalité des usages de la dignité, de montrer l'ambivalence de ce concept et devrait ainsi inciter tous ceux qui s'y réfèrent en pratique, notamment les juges, les politiques, les médecins ou les citoyens, à agir en conséquence afin d'éviter que cet outil de défense des droits de la personne se transforme en censeur de libertés ou en instrument d'injustice sociale.

De nombreux auteurs sont prompts à y voir aujourd'hui le fondement de tous les droits fondamentaux ou encore le principe cardinal de l'ordre juridique dans sa globalité : destinée paradoxale d'un principe qui, il y a peu encore, n'avait pas reçu de consécration explicite en droit positif français. Ce constat constitue le point de départ d'une réflexion sur les forces à l'œuvre dans la promotion d'un tel principe, méconnu sinon ignoré hier, célébré aujourd'hui comme tout à fait essentiel. Le présent ouvrage vise donc à analyser le processus de juridicisation qui a affecté le principe de dignité de la personne humaine, au moyen d'une confrontation le plus systématique possible entre les usages qu'en font les juges nationaux et la portée que lui confère la doctrine. Cette analyse produit des résultats étonnants par leur caractère démonstratif mettant en évidence une dimension massivement prescriptive du discours doctrinal sur ce sujet. Cette hypothèse interprétative est proposée au terme d'une recherche qui analyse de manière distincte le discours doctrinal (dans ses différentes versions constitutionnaliste, administrative, civiliste, de droit social...) et le discours juridictionnel (analysé à partir d'un corpus de 337 décisions de justice). Si de cette manière Dieu n'est pas étranger à notre condition humaine, c'est alors l'humanité commune qui est le lieu pour être digne et agir dignement, et en premier lieu là où la dignité humaine est à l'épreuve de sa vulnérabilité ou des dénis qu'on lui oppose. Dans le volet théologique de ce volume, quatre contributions montrent l'actualité de la question, en soulignant l'importance d'un « agir digne », sans lequel la dignité est réduite à une valeur incantatoire. Or le combat pour la dignité, sous ses multiples formes, c'est aussi la dignité elle-même qui se fraie un chemin d'humanisation : ce chemin qui n'est pas étranger à celui qu'emprunte l'agir de Dieu, digne de lui en tant que salut de l'humain.

Even if the United Nations entitles all people to justice for water, more responsible and ethical use of it by all interested parties is more important than the spreading of promises, which, in practice, may turn out to be a sham. Only a better understanding that access to water rests on the efforts of everyone, without exception, will reduce overuse, waste, and pollution of the indispensable resource. This volume, while written from a theological, philosophical, and legal perspective (focusing on John Calvin, John Rawls, and Paul Ricoeur), demonstrates that water cannot be merely understood as a human right, but also has to be dealt with from an economic point of view as well as under the authority of the Golden Rule.
