Book excerpt: El ordenamiento jurídico español, ha ido regulando la enfermedad profesional en diferentes normas, pasando de una protección unificada junto al accidente de trabajo con la aparición de la Ley de Accidentes de Trabajo de 1900, hasta nuestro días contemplándolas en el Real Decreto 1299/206 de 10 de noviembre de manera independiente. Ahora bien, solo aquellas reguladas en el Real Decreto 1299/206, serán profesionales y no hará falta demostrar la relación de causalidad entre el trabajo desarrollado y la enfermedad producida ya que esto se presume, a diferencia de las enfermedades de trabajo que salvo las que se produzcan de manera súbita e inesperada en lugar y tiempo de trabajo, se deberá demostrar su relación de causalidad. El actual Real Decreto 1299/2006 vino a cubrir y sustituir las carencias del cuadro de enfermedades profesionales de 1978 debido a su desfase en el tiempo, ya que impedía que se regulasen nuevas enfermedades profesionales, pero aun así no cumplió las expectativas previstas dejando muchas de las enfermedades sin regular como son las psicosociales, destacando una mejora en el sistema de notificación y registro, y ampliando y restructurando mínimamente el cuadro de enfermedades profesionales. Finalmente para prevenir enfermedades profesionales en puestos con riesgos de contraerlas, se prevén medidas como es la prohibición de contratación en determinados puestos de trabajo a trabajadores sensibles y en concreto a trabajadores menores de edad y trabajadores en empresas de trabajo temporal, la obligatoriedad de realizar reconocimientos médicos antes de contratar y de manera periódica en un intervalo de tiempo establecido en la normativa específica , y en su caso llevar a cabo una movilidad geografía o funcional cuando se materialice el riesgo en la salud del trabajador, adoptando en último lugar la extinción del contrato de trabajo.
