McCoy explores how newly democratizing nations can avoid reverting to authoritarian solutions in response to the daunting problems brought about by sudden change. The troubled transitions that have derailed democratization in nations worldwide make this problem a major concern for scholars and citizens alike. The book presents original case studies based on empirical field research of court disputes in West Java, a majority-Muslim province with a history of radical Islam. The book argues that the democratic law reform process has been influenced by radical Islamists because of the politicization of religion under democracy and the persistence of fears of Christianization. It was insider-dominated and gradualist and it involved free elections before a lengthy process of constitutional reform. By proceeding as they did, the Indonesians averted the conflict that would have arisen between adherents of the old constitution and proponents of radical, immediate reform. Donald L. He then traces the effects of the new institutions on Indonesian politics and discusses their shortcomings and their achievements in steering Indonesia away from the dangers of polarization and violence.
