Book Equality and Preferential Treatment

Download or read book Equality and Preferential Treatment written by Marshall Cohen and published by Princeton University Press. This book was released on 1977-08-21 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: These essays, with one exception originally published in Philosophy & Public Affairs, consider the moral problems associated with improving the social and economic position of disadvantaged groups. If the situation of women and minorities improves so that their opportunities are equal to those of more favored groups, will they then be in a competitive position conducive to equal achievement? If not, can preferential hiring or preferential admission to educational institutions be justified? The contributors explore the complexities of this problem from several points of view. The discussions in Part I are more theoretical and concentrate on the application to this case of general considerations from ethical theory. The discussions in Part II also take up theoretical questions, but they start from specific problems about the constitutionality and the effectiveness of certain methods of achieving equality and counteracting discrimination. The two groups of essays demonstrate admirably the close connection between moral philosophy and questions of law and policy. The issues discussed include compensation, liability, victimization, the significance of group membership, the intrinsic importance of racial, sexual, or meritocratic criteria, and the overall effects of preferential policies.

Book excerpt: West Virginia lawyer, Jack Fabian, is a battle-hardened, hard-drinking personal injury trial lawyer concentrating his practice in medical malpractice plaintiffs cases. Fabian, who has developed a penchant for big spending, expensive airplanes, top-shelf booze, and luxury vacations finds himself in 2005, feeling the adverse effects of the recently enacted repressive medical malpractice tort reform law in his state that has dulled his enthusiasm for the practice in general and plaintiffs malpractice law in particular. Through a series of unforeseen circumstances, Fabian reluctantly finds himself teamed up with former adversary, Benjamin Darnell, a recently deposed partner in a large insurance defense law firm and becomes embroiled in a case against a young neurosurgeon who, the two contend, botched his first surgery since completing training. Preferential Treatment is a story of two former foes pitted against the litigation sections chairman of Darnells old firm and his young associate in a case that could make or break each of their small practices. The book gives the reader a birds-eye view of the rough and tumble of the practice of law in a dying West Virginia town and the risks few lawyers dare to takethe difficult, time-consuming, and expensive practice of medical malpractice litigation.

Download or read book Special Treatment written by Anna Ruddock and published by Stanford University Press. This book was released on 2021-07-06 with total page 334 pages. Available in PDF, EPUB and Kindle. Book excerpt: The All India Institute of Medical Sciences (AIIMS) is iconic in the landscape of Indian healthcare. Established in the early years of independence, this enormous public teaching hospital rapidly gained fame for the high-quality treatment it offered at a nominal cost; at present, an average of ten thousand patients pass through the outpatient department each day. With its notorious medical program acceptance rate of less than 0.01%, AIIMS also sits at the apex of Indian medical education. To be trained as a doctor here is to be considered the best. In what way does this enduring reputation of excellence shape the institution's ethos? How does elite medical education sustain India's social hierarchies and the health inequalities entrenched within? In the first-ever ethnography of AIIMS, Anna Ruddock considers prestige as a byproduct of norms attached to ambition, aspiration, caste, and class in modern India, and illustrates how the institution's reputation affects its students' present experiences and future career choices. Ruddock untangles the threads of intellectual exceptionalism, social and power stratification, and health inequality that are woven into the health care taught and provided at AIIMS, asking what is lost when medicine is used not as a social equalizer but as a means to cultivate and maintain prestige.

Book excerpt: A man on top of the world. Mikhail Volkov began life as an orphan, raised in abject poverty on the fringes of a crumbling empire. Now he's the ruler of his own empire-founder and CEO of Domovoy Technologies-and one of the wealthiest men in the world. Unfathomable luxury, comfort, and power is always at his fingertips. He wants for nothing-except for one elusive desire?A woman strong enough to conquer him. After years of struggle, Kate Pasternak has managed to claw her way above the poverty line to a life of moderate comfort-clean clothes, regular meals, a safe home. It's a precarious position, balanced on the knife's edge between her paycheck and her existing debts. But a chance encounter with the CEO of the company she works for could change all that.An indecent proposal. Mikhail Volkov has the money to get Kate out of debt. All he wants in return is? companionship. But this isn't the usual kind of arrangement. The hard-edged, cutthroat tech baron might be an alpha in the boardroom but, for the right woman, he lives to serve in the bedroom. It seems too good to be true. And it probably is-because the deeper Kate gets entangled, the more she risks losing her own heart to a man who may not even have one.

Available in PDF, EPUB and Kindle. Book excerpt: During the last half of the twentieth century, legal philosophy (or legal theory or jurisprudence) has grown significantly. It is no longer the domain of a few isolated scholars in law and philosophy. Hundreds of scholars from diverse fields attend international meetings on the subject. In some universities, large lecture courses of five hundred students or more study it. The primary aim of the Law and Philosophy Library is to present some of the best original work on legal philosophy from both the Anglo-American and European traditions. Not only does it help make some of the best work avail able to an international audience, but it also encourages increased awareness of, and interaction between, the two major traditions. The primary focus is on full-length scholarly monographs, although some edited volumes of original papers are also included. The Library editors are assisted by an Editorial Advisory Board of internationally renowed scholars. Legal philosophy should not be considered a narrowly circumscribed field.
