This book was released on 2015-07-12 with total page 688 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Practice and Pleading in Personal Actions in the Courts of Massachusetts In the preparation of the present edition, the second edition has been thoroughly revised, and all obsolete matter stricken out. A large amount of new matter has been added, under the different topics treated of; among which may, especially, be mentioned the subjects of the Courts and their Jurisdiction, Certiorari, Review, Writ of Error, Trustee Process, Judgment and Execution, Appeals, and Exceptions. The new matter added to the book amounts, altogether, to about one hundred pages. About five hundred citations of cases have been added, including all the cases decided, upon points of pleading or practice, by the Supreme Judicial Court, since the publication of the second edition. All new legislation in any way affecting the subjects treated of, from that of the legislative session of 1883 to and including the important legislation of the session of 1893, has been noted. Gratefully acknowledging the favor with which the former editions of their work have been received, the authors submit the present edition to the indulgent consideration of the legal profession of the Commonwealth. Book Practice and Pleading in Actions in the Courts of Record in the State of New York Under the Code of Procedure and Other Statutes When Applicable

Download or read book Practice and Pleading in Actions in the Courts of Record in the State of New York Under the Code of Procedure and Other Statutes When Applicable written by Henry Whittaker and published by Forgotten Books. This book was released on 2017-11-07 with total page 1066 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Practice and Pleading in Actions in the Courts of Record in the State of New York, Under the Code of Procedure, and Other Statutes, When Applicable: With an Appendix of Forms The author has, on the other hand, omitted from the present edition his former brief notice of independent special proceedings, and also the concluding chapter as to the retrospective effect of the Code. The latter subject has become practically obsolete; the former is, in fact, foreign to the plan of the work. That plan remains substantially the same as before. The progress of a suit in the higher courts of the state is traced, from its origin and preliminaries, down to its final determination; practical directions being given for its conduct and management, in each step which may be necessary or advisable during that progress. The provisions of the Code, of the Revised or General Statutes, and of the Rules of the Courts, which bear upon each particular division of the general subject, are, on the present occasion, cited in the body of the work, instead of being subjoined at its close. An appendix of forms is added, as heretofore, and each volume closes with an index of the subjects considered in it. The first embraces all matters connected, directly or indirectly, with the commencement and progress of a suit, down to the preparation and service of the complaint, inclusive; the second, all subsequent stages of procedure, in that suit, down to its close. Book Important Features of Pleading and Practice

Download or read book Important Features of Pleading and Practice written by Harold R. Medina and published by Forgotten Books. This book was released on 2017-10-11 with total page 280 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Important Features of Pleading and Practice: Under the New York Civil Practice Act A perhaps not surprising but at least significant fact is that since October lst, 1921, there have been over 650 decisions relating to sections of the Civil Practice Act and the Rules of Civil Practice appearing in the New York Law Journal alone. All of these decisions, and also a considerable number from other parts of the state, have been carefully considered in connection with these lectures. It is a great pleasure to note that, with a very few exceptions, the distinct tendency of the courts in all parts of the state has been to interpret the provisions of the new law in a broad and liberal spirit. No doubt some errors will be found herein. It is hoped they may be few and that they may not be judged too harshly.
