Book Race Crime and the Law

Download or read book Race Crime and the Law written by Randall Kennedy and published by Vintage. This book was released on 2012-02-22 with total page 559 pages. Available in PDF, EPUB and Kindle. Book excerpt: An "admirable, courageous, and meticulously fair and honest book” (New York Times Book Review) in which “one of our most important and perceptive writers on race" (The Washington Post) takes on a highly complex issue in a way that no one has before. "This book should be a standard for all law students."—Boston Globe In this groundbreaking, powerfully reasoned, lucid work that is certain to provoke controversy, Harvard law professor Randall Kennedy takes on a highly complex issue in a way that no one has before. Kennedy uncovers the long-standing failure of the justice system to protect blacks from criminals, probing allegations that blacks are victimized on a widespread basis by racially discriminatory prosecutions and punishments, but he also engages the debate over the wisdom and legality of using racial criteria in jury selection. He analyzes the responses of the legal system to accusations that appeals to racial prejudice have rendered trials unfair, and examines the idea that, under certain circumstances, members of one race are statistically more likely to be involved in crime than members of another.

Available in PDF, EPUB and Kindle. Book excerpt: Problem Solving Courts explores a relatively new approach to criminal justice--one that can have a powerful impact on how convicts connect with their communities. Problem solving courts, born out of the drug court movement in the 1980s, are run by judges who, with the assistance of law enforcement agents and mental health workers, meet with convicts on a weekly basis to talk about their treatment. Treatment programs often include therapy, in addition to the possibility of incarceration or early "parole" in which an offender can complete his or her sentence under the jurisdiction of the court. In this unique collaboration, scholar JoAnn Miller and judge Donald C. Johnson, creators of three successful problem solving courts themselves, address the compelling needs for alternatives to prisons, analyze problem solving courts in depth, and assess the impact problem solving courts can have on convicts and their communities. Problem solving courts can include: community courts that seek to improve the quality of life in neighborhoods struggling with crime and disorder; drug treatment courts that link addicted offenders to drug treatment instead of incarceration; family treatment courts that seek to stop the cycle of drugs, child neglect, and foster care; and domestic violence courts that emphasize victim safety and defendant accountability.

Book Conviviality and Survival

Download or read book Conviviality and Survival written by Sacha Darke and published by Springer. This book was released on 2018-07-16 with total page 364 pages. Available in PDF, EPUB and Kindle. Book excerpt: Brazilian authorities continuously fail to comply with international norms on minimal conditions of incarceration. Brazil's prison population has risen ten-fold since the country's return to democracy in the 1980s. Its prisons typically operate at double official capacity and with 100 prisoners for each guard on duty. At the same time, however, the average Brazilian prison is not as disorderly or its staff-inmate relations so conflictual as our established theories on prison life might predict. This monograph explores the means by which Brazilian prisons function in the absence of guards. More specifically, the means by which prison security and inmate discipline is negotiated between prison managers, gangs and the wider inmate body. While fragile and varied, this historical tradition of co-produced governance has for decades kept most prisons in better order and enabled most prisoners to better survive.
