Book excerpt: The challenges facing resource management, including transboundary river basins, have become increasingly complex, requiring more holistic readings of governance processes that encompass a range of formal and informal collaborations between diverse actors. Innovation and transformative governance changes hold potential for addressing the increased complexity and multi-scaled nature of the challenges facing the world's shared rivers. However, significant research gaps exist around this application in practice. This dissertation asks the following questions: Is governance of transboundary waters changing to integrate a more diverse set of actors beyond centralized governments? If so, what is the role of non-central state actors in contributing to innovations and transformative changes to transboundary water governance processes? In working towards answering these questions, the study explores the case of the Columbia River Treaty (North America) and the Lesotho Highlands Water Project (Southern Africa). This study has the following objectives: first, to determine the type of power, albeit conceived from a Euro-western perspective, that non-central state actors mobilize to engage in transboundary water governance processes, and assess if the power these actors mobilize is contributing to changes in governance. Second, to conceptualize the on-going bordering processes for transboundary water governance, and evaluate whether non-central state actors are shaping these processes. And, third, to identify which non-central state actors are involved in transboundary water governance, and examine whether and how these governance systems are becoming more polycentric. This dissertation is composed of five chapters, three of which have been prepared as standalone articles for submission to academic journals. Broadly, the dissertation findings suggest that changes to governance of transboundary waters, away from state-centric processes, may be emerging in some areas, such as the ability of non-central state actors to exercise and mobilize different forms of power to shape water governance processes. Findings illustrate that a clear distinction between international and national processes is no longer sufficient to address transboundary water governance challenges and issues. Further, findings illustrate that some non-central state actors have power and influence in these transboundary water governance processes. However, these insights also highlight that centralized government authority for transboundary waters remains, and evidence of the emergence of polycentric governance systems at the international scale is limited.

Book excerpt: Having succeeded in establishing themselves in Europe, Asia, Africa and the Americas, in the early 16th century Spain and Portugal became the first imperial powers on a worldwide scale. Between 1580 and 1640, when these two entities were united, they achieved an almost global hegemony, constituting the largest political force in Europe and abroad. Although they lost their political primacy in the seventeenth century, both monarchies survived and were able to enjoy a relative success until the early 19th century. The aim of this collection is to answer the question how and why their cultural and political legacies persist to date. Part I focuses on the construction of the monarchy, examining the ways different territories integrated in the imperial network mainly by inquiring to what extent local political elites maintained their autonomy, and to what a degree they shared power with the royal administration. Part II deals primarily with the circulation of ideas, models and people, observing them as they move in space but also as they coincide in the court, which was a veritable melting pot in which the various administrations that served the Kings and the various territories belonging to the monarchy developed their own identities, fought for recognition, and for what they considered their proper place in the global hierarchy. Part III explains the forms of dependence and symbiosis established with other European powers, such as Genoa and the United Provinces. Attempting to reorient the politics of these states, political and financial co-dependence often led to bad economic choices. The Editors and Contributors discard the portrayal of the Iberian monarchies as the accumulation of many bilateral relations arranged in a radial pattern, arguing that these political entities were polycentric, that is to say, they allowed for the existence of many different centres which interacted and thus participated in the making of empire. The resulting political structure was complex and unstable, albeit with a general adhesion to a discourse of loyalty to King and religion.

Book excerpt: This book explores the role and status of local and regional authorities (also referred to as 'subnational authorities' or 'SNAs') in European Union law, and reveals the existence of two parallel yet opposed constitutional imaginations of the supranational legal order. Through a survey of various areas of EU law, including primary and secondary legislation, case law as well as various soft law instruments, Finck introduces two narratives. These are the 'outsider narrative' and the 'insider narrative' that frame these constitutional imaginations. According to the outsider narrative, the structure of the legal order is bi-centric, composed of the member states and the EU only. This narrative envisages SNAs as outsiders of EU law, whose interactions with Union law are merely of an indirect nature. However, in addition to this well-known account of EU law, a parallel yet distinct narrative can be identified according to which SNAs are insiders that entertain direct relations with the European Union and contribute to the substantive development of EU law. It is illustrated that the coexistence of both narratives has wider implications as it points towards a shift in the structure of the European legal order itself, which is transitioning from bi-centricity to polycentricity.
