Book Parris s Standard Form of Building Contract

Download or read book Parris s Standard Form of Building Contract written by David Chappell and published by John Wiley & Sons. This book was released on 2008-04-15 with total page 378 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Joint Contracts Tribunal Standard Form of Building Contract, JCT 98, is now a well established and widely used form. That is not to say, however, that it is always well understood. It is a large, complex contract with a number of particularly difficult provisions. It is not surprising, therefore, that not much guidance has been published on the form. This book, first written by John Parris in 1982, and revised in 1985, was widely regarded as a valuable commentary on the Standard Form. Unavailable for some years, it has now been substantially updated and completely rewritten by David Chappell. Major changes have occurred since the last edition, including a raft of amendments to the contract itself, much new legislation including the Housing Grants, Construction and Regeneration Act 1996, and substantial new case law. The book covers all these as well as the complex performance specified work provisions and the difficult problems of nomination. The nominated sub-contract conditions are referred to where appropriate, and the book contains guidance on related matters, such as warranties, letters of intent and quantum meruit. The book is not simply a re-writing of the contract in simply terms. It contains very valuable insights and much needed guidance on some of the lesser known implications of the current form The book will provide a valuable reference for clients' professional advisers and contractors, as well as for lawyers needing an introduction to the contract.

Book The JCT Minor Works Building Contracts 2005

Download or read book The JCT Minor Works Building Contracts 2005 written by David Chappell and published by John Wiley & Sons. This book was released on 2008-04-15 with total page 264 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Minor Works Building Contract is the most widely used of the JCT forms of contact, not only for simple, short contracts of moderate price, for which it is intended, but also for much larger projects for which it is often not suited at all. As a result, contractual difficulties can arise, and despite the form's simplicity an understanding of the legal background to the form is essential. This book explains the practical applications of the form from the point of view of the employer, architect and contractor. It provides a straightforward explanation of the legal aspects of the form supported by flow charts, tables and sample letters. The Fourth Edition has been revised to cover the 2005 edition of the form, which has given the contract a completely new look. The book now covers the new JCT Minor Works Building Contract with contractor's design (MWD).

Book Powell Smith and Furmston s Building Contract Casebook

Download or read book Powell Smith and Furmston s Building Contract Casebook written by Michael Furmston and published by John Wiley & Sons. This book was released on 2012-01-11 with total page 482 pages. Available in PDF, EPUB and Kindle. Book excerpt: Powell-Smith and Furmston’s Building Contract Casebook The interaction between general principles and the provisions of the standard building and construction contracts is a central feature of construction law. The major part of the law is laid down in decided cases and construction professionals should be familiar with these cases, but the information is scattered throughout a large number of law reports. The fifth edition of Powell-Smith and Furmston’s Building Contract Casebook is designed to help construction professionals become familiar with those key cases. It brings together a wide range of cases on the main aspects of the law of construction contracts, states the principle established by each case and gives a summary of the facts and the decision. For the majority of cases, verbatim extracts from the judgment are included. The casebook presents the leading cases on each topic, together with many lesser-known but important decisions. A number of useful decisions from the Commonwealth are also included. Throughout, the author’s approach is practical rather than academic.

  • Author : Nael G. Bunni
  • Publisher : John Wiley & Sons
  • Release : 2013-02-05
  • ISBN : 1118658655
  • Pages : 731 pages

Download or read book The FIDIC Forms of Contract written by Nael G. Bunni and published by John Wiley & Sons. This book was released on 2013-02-05 with total page 731 pages. Available in PDF, EPUB and Kindle. Book excerpt: In September 1999, FIDIC introduced its new Suite of Contracts, which included a “new” Red, Yellow, Silver and Green forms of contract. The “new” Red Book was intended to replace the 1992 fourth edition of the Red Book, with the ambition that its use would cease with time. This ambition has not materialised and is unlikely to do so in the future. Despite the importance of the 1999 Forms, there has been very little published on the new concepts adopted in them and how they interact with the previous forms. This important work considers these aspects together with the many developments affecting the fourth edition of the Red Book that have taken place since 1997, when the second edition of this book was published, and relates them to key contracting issues. It is written by a chartered engineer, conciliator and international arbitrator with wide experience in the use of the FIDIC Forms and in the various dispute resolution mechanisms specified in them. Important features of this book include: · background and concepts of the various forms of contract; · a detailed comparison of the wording of the1999 three main forms, which although similar in nature; it nevertheless significantly differs in certain areas where the three forms diverge due to their intended purpose; · analysis of the rights and obligations of the parties involved in the contract and the allocation of risks concerned; · a range of ‘decision tree’ charts, analysing the main features of the 1992 Red Book, including risks, indemnities and insurances, claims and counterclaims, variations, procedure for claims, programme and delay, suspension, payments and certificates, dispute resolution mechanisms, and dispute boards; · a much enlarged discussion of the meaning of “claim” and “dispute” and the types of claim with a discussion of the Notice provision in the 1999 forms of contract for the submittal of claims by a contractor and by an employer; · the FIDIC scheme of indemnities and insurance requirements; and the methods of dispute resolution provided by the various forms of contract; and · five new chapters in this third edition, the first four chapters deal with each of the 1999 forms and the fifth chapter is confined to the topic of Dispute Boards.
