Book excerpt: Over the past decade, labour market outcomes have improved in India, with net employment rising markedly for the economy as a whole. However, these gains have arisen primarily in the unorganized and informal sectors of the economy, where productivity and wages are generally much lower than in the formal organized sector. It is only India's organized sector that is subject to labour market regulation, and here employment has fallen. The role of employment protection legislation in affecting employment outcomes is controversial both in the OECD area and in India. This paper looks at the impact of employment protection legislation and related regulation on the dynamics of employment in the organized sector of the economy, using newly constructed measures of national regulation and state labour reforms. We find that while reforms have taken some of the bite out of core labour laws, more comprehensive reforms are needed to address the distortions that have emerged.

Book excerpt: This paper investigates the implications of lowering formal regulations in labor and product markets on informality and macroeconomic outcomes in India. We estimate a DSGE model with an informal sector, and rigidities in the formal labor and product markets. Along with increasing GDP and employment, deregulation also leads to lower informality and greater product market competition. Slow reallocation of resources between the formal and informal sectors leads to some adverse impacts in the short run that can be minimized by implementing a combined package of reforms. These impacts are shown to be greater in an economy with a larger informal sector.

Available in PDF, EPUB and Kindle. Book excerpt: This paper offers a critique of recent empirical research on the impact of labour regulation on industrial performance in India. It begins with a review of earlier studies that tried to infer the effects on manufacturing employment of amendments made by the central government to the Industrial Disputes Act (IDA) in 1976 and 1982, requiring official permission for layoffs, retrenchments and closures. The results of these studies are ambiguous, and this literature ignored crucial developments in the political and legal spheres which vitiate many of these findings. The widely-used index of state-level labour regulation devised by Besley and Burgess (Quarterly Journal of Economics, 2004) is then criticised for its miscoding of individual amendments and its misleading aggregation and cumulation procedures. Their econometric results, which indicate that states that enacted excessively pro-worker amendments to the IDA have displayed poorer performance in manufacturing, do not appear to be robust and also suffer from other methodological problems. Several recent studies that have used the Besley-Burgess index are also surveyed, and their limitations highlighted. Finally, the paper reviews a wide range of other evidence, pointing in a very different direction, on the actual enforcement of labour laws, labour flexibility, and industrial employment. Throughout, attention is paid to the crucial role of judicial interpretation of the IDA, which has been neglected in this literature.

Book excerpt: At the macro level, productivity is driven by technology and the efficiency of resource allocation, as outcomes of firms’ decision making. The relatively high level of resource misallocation in India’s formal manufacturing sector is well documented. We build on this research to further investigate the drivers of misallocation, exploiting micro-level variation across Indian states. We find that states with less rigid labor markets have lesser misallocation. We also examine the interaction of labor market rigidities with informality which is a key feature of India’s labor markets. Our results suggest that reducing labor market rigidities in states with high informality has a net positive effect on aggregate productivity.

Book excerpt: While it's easy to blame globalization for shrinking job opportunities, dangerous declines in labor standards, and a host of related discontents, the "flattening" of the world has also created unprecedented opportunities for worker organization. By expanding employment in developing countries, especially for women, globalization has formed a basis for stronger workers' rights, even in remote sites of production. Using India's labor movement as a model, Rohini Hensman charts the successes and failures, strengths and weaknesses, of the struggle for workers' rights and organization in a rich and varied nation. As Indian products gain wider acceptance in global markets, the disparities in employment conditions and union rights between such regions as the European Union and India's vast informal sector are exposed, raising the issue of globalization's implications for labor. Hensman's study examines the unique pattern of "employees' unionism," which emerged in Bombay in the 1950s, before considering union responses to recent developments, especially the drive to form a national federation of independent unions. A key issue is how far unions can resist protectionist impulses and press for stronger global standards, along with the mechanisms to enforce them. After thoroughly unpacking this example, Hensman zooms out to trace the parameters of a global labor agenda, calling for a revival of trade unionism, the elimination of informal labor, and reductions in military spending to favor funding for comprehensive welfare and social security systems.
