They levied additional taxes upon a scale without precedent since 1933. In some circles, the General Assembly has been criticized for levying these new taxes and for budget spending that reaches an all-time high. While these areas of criticism are recognized, from the standpoint of sound finance, it must be conceded by all that the General Assembly had the courage of their convictions. They insisted upon a balanced budget. From a fiscal standpoint, what the General Assembly did is to be commended. Book excerpt: Excerpt from Popular Government, Vol. 36: October 1969; The Legislative Issues Inciting to riot, covered in the same section, is made a general misdemeanor by this act if, as a result of the inciting or urging, a riot occurs or a clear and present danger of a riot is created. Inciting or urging another to engage in a riot is a felony, punishable by up to ten years' imprisonment, if it is a contributing cause of a riot in which there is property damage in excess of or serious bodily injury. A provision closely related to those of disorderly conduct, riot, and inciting to riot is failure to disperse when commanded. Under the provisions of a new g.s. 14 anyone failing to comply with a lawful order to disperse (authority for which is given to any law enforcement officer when he reasonably believes the riot or disorderly conduct by three or more per sons is occurring) is guilty of a misdemeanor punish able by a fine not exceeding $500 or imprisonment for not more than six months. Also, remaining at the scene of a riot or disorderly conduct following a com mand to disperse after a reasonable time for dis persal has elapsed becomes prima facie evidence that the person remaining is willfully engaging in the riot or disorderly conduct. Book excerpt: Excerpt from Popular Government, Vol. 36: September 1969 Other strong supporters of consumer-oriented legislation this year included Attorney General Mor gan and Commissioner of Agriculture Graham. In his legislative program the Attorney General stressed bills to bolster his new Consumer Protection Division measures to adopt state unfair and deceptive trade practices legislation, to strengthen and broaden North Carolina's antimonopoly legislation, and to direct the Attorney General to represent the interest of the con sruning and using public before courts and regulatory agencies. Proposed agricultural legislation this year included bills to strengthen the Commissioner's hand in enforcing sanitary requirements for soft-drink bottlers, to enable the Commissioner to establish standards of quality under the Egg Law for consumer protection, and to revise the state meat inspection law. A box score on consumer-backed legislation shows a mixture of successes and failures, but over-all a substantial achievement. The legislative programs of the Attorney General and the Commissioner of Agri culture were largely enacted, as were increases in minimum wages and workmen's compensation bene fits. Once again, ' abolition of capital punishment and regulation of day-care centers failed, though the latter came close to passage in the waning stages of the session. The session-long battle over interest rates was finally resolved on the last day by adoption of a con ference report that resolved a compromise between the lender-backed Senate bill and the more consumer oriented House bill. On 8 December he communicates his first annual message to Congress: peace between France and England is restored; a rise in population will increase revenue and help abolish internal taxes; the standing army can be done away with; "peace & friendship" prevail with Indian neighbors. He recommends two particular matters to the attention of Congress: a revision of the laws on naturalization and a review of the Judiciary Act. Two delegations of Indian nations hold conferences with Jefferson and Secretary of War Henry Dearborn in Washington. Jefferson observes that it is good for them to "renew the chain of affection." The president receives a "Mammoth Cheese" as a token of esteem from the citizens of Cheshire, Massachusetts, and the letter from the Danbury Baptists arrives. In his famous reply to the Baptists, Jefferson states that "religion is a matter which lies solely between man & his god." Shortly after legislators arrive in town for the opening of Congress, he begins to entertain at the President's House. He uses such occasions to bridge the divide between the executive and legislative branches and foster political understanding between Republicans and Federalists. As he moves into his second year as president, he is optimistic about his legislative program and the Republican majority in Congress.
