Book excerpt: This book analyses why the Ukrainian state established asylum laws and policies in the thirty years since 1991, even though the number of asylum seekers was very low. International and non-governmental organisations transferred international asylum norms to Ukraine. Various state and non-state actors participated in this process, translating, spreading, and resisting those norms. In many cases, legislative adoption was driven by domestic politicians’ pursuit of recognition by international organisations, such as the European Union and the Council of Europe, and by their desire to meet conditionality requirements. NGOs sought to influence administrative practices, alternating between confrontational and conciliatory, formal and informal approaches, and often relying on personal contacts. Actors used and shifted between scales in order to transfer norms or resist transfer. In the process, they produced, renegotiated, and confirmed those scales. For instance, NGOs resorting to the European Court of Human Rights to prevent refoulement placed the European scale above the national scale. This book offers a new multi-actor and multi-scalar analysis of policy transfer.

Book excerpt: This book contributes to existing debates on the Responsibility to Protect (R2P) by demonstrating new advocacy strategies and the greater interconnectedness of various R2P proponents. In 2021, the UN General Assembly adopted a new resolution on R2P, which reaffirmed its commitment from the 2005 World Summit Outcome and put R2P on the annual agenda. For many R2P proponents, this was another manifestation of worldwide R2P relevance and of growing support among UN members to protect people from genocide, war crimes, ethnic cleansing and crimes against humanity. Yet the existing crises in Myanmar, Venezuela, Belarus, Syria and many others revealed the widening gap between the discourse and practice. This book aims to find out what keeps the concept alive despite its indisputable pitfalls. In contrast to existing studies that treat the R2P endorsement or contestation as intertwined processes of norm evolution, it argues that the status of R2P has been accomplished by the conscious politics of its advocates operating in complex global networks. As such, the book puts emphasis on the agency of R2P champions and examines who keeps the idea resonating and how they manage to preserve its worldwide relevance. Rather than proposing a new model of advocacy, the book aims to pinpoint the politics of R2P's circulation, the importance of individual R2P champions and their interconnectedness through innovative forms of cooperation within complex networks. Book excerpt: Redefining EU Membership examines the issue of Membership within the European Union (EU) today by focusing on differentiation in and outside the EU. The Treaty on European Union unequivocally declares that the contracting parties are the Member States of the EU. However, a closer examination casts some doubt of the unitary status of Member States, or at least suggests that the concept requires nuancing. Whilst diversity, and to some extent differentiation, have been part and parcel of the European integration process since its inception, Redefining EU Membership proposes that, considering several developments, a new reflection on membership within the EU and on differentiation in and outside the EU is required. The volume's contributions are organized around four aspects of the tensions faced by the concept of a unitary and formal EU membership: first, an examination of key policy areas which have already witnessed various forms of differentiated integration; second, an analysis of 'special statuses' within the EU; third, important examples of non-Member States in which EU law is applied (with and without their participation in the EU's decision-making process); and fourth, the situation of states under accession or secession procedures which obliges them to accept EU norms and policies even prior to/after formal membership. These analyses are complemented by a reflection on the concept of membership in itself. In a context in which EU enlargement appears likely, the provided analysis reflects on the need to expand and introduce several kinds of membership to the EU in the future.
