Book excerpt: Looking at the growing use of federalism and decentralization as tools of conflict resolution, this book provides evidence from several case studies on the opportunities and challenges that territorial solutions offer when addressing internal conflicts within a variety of countries. Federalism has been used as a tool of conflict resolution in a number of conflict situations around the world. The results of this have been mixed at best, with some countries moving slowly to the paths of peace and recovery, while others have returned to violence. This volume looks at a number of case studies in which federalism and decentralization have been promoted in order to bring opposing groups together and protect the territorial integrity of different countries. Yet, it is demonstrated that this has been incredibly difficult, and often overshadowed by wider concerns on secession, de and re-centralization and geopolitics and geoeconomics. While federalism and decentralization might hold the key to keeping war-torn countries together and bringing hostile groups to the negotiation table, we nevertheless need to rethink under which conditions territorial autonomy can help to transform conflict and when it might contribute to an increase in conflict and violence. Federalism alone, so the key message from all contributions, cannot be enough to bring peace – yet, without territorial solutions to ongoing violence, it is also unlikely that peace will be achieved. This new introduction to the field posits that policy analysis should have both a broader interdisciplinary base—including criteria from such fields as political science, sociology, law, and philosophy, as well as economics—and also a broader audience in order to foster democratic debate. To achieve these goals, MacRae and Whittington have organized their textbook around the construction of decision matrices using multiple criteria, exploring the uses of the decision matrix formulation more fully than other texts. They describe how to set up the matrix, fill in cells and combine criteria, and use it as an aid for decision making. They show how ethical assessment of the affects that alternatives have on various parties differs from political analysis, and then they extend the use of the decision matrix to consider alternatives by affected parties, periods of time, or combined factors. The authors also thoughtfully address the role of expert advice in the policy process, widening the scope of the field to describe a complex system for the creation and use of knowledge in a democracy. This book analyzes the Liberian transition and the July 1997 elections in order to better understand the relationship between war termination and transitions to democracy and the role post-conflict elections play in promoting both of these goals. The Liberian elections represented the final stage of a seven-year, West African-led peace process. An overwhelming majority voted for former factional leader Charles Taylor in the belief that if Taylor did not win, war would erupt again. The Liberian transition demonstrates that post-conflict elections may play an important role in a process of war termination. In many cases, it may be necessary to move forward with war termination and "imperfect" elections in the short run and pursue goals relating to democratization after the new government has been put in place. This study uses a detailed examination of the difficult Liberian case to highlight the more general challenges of helping countries make the transition from civil conflict and authoritarian rule to peace and democracy. This book explores how a European political community can be advanced through EU constitutional law. The constitutional role of the Union is to ensure peace by addressing two types of conflict. The first are static conflicts of interests between the national polities in the EU. These are avoided by ensuring reciprocal non-interference between Member States in the Union through deregulation in Union law. The second are dynamic conflicts of ideas about positive liberty held by the peoples of Europe. These can be resolved through regulation in a European political space. Here, EU law enables a continuous process of re-negotiating a shared European idea of positive liberty that can be accepted as its own by each national polity in the EU. These solutions to the two types of conflicts correspond to the liberal and republican models for Europe. The claim of this book is that the constitutional design of Europe presents both liberal and republican features. Taking an innovative approach, which draws on arguments from substantive law, constitutional theory, case law analysis, insights from psychology and philosophy, it identifies how best to strengthen the Union through constitutional law.
