Book Welsh Planning Law and Practice

Download or read book Welsh Planning Law and Practice written by Graham Walters and published by University of Wales Press. This book was released on 2017-09-15 with total page 428 pages. Available in PDF, EPUB and Kindle. Book excerpt: Welsh Planning Law and Practice provides a comprehensive guide to the sources and structure of Welsh planning law and a route through its complexity. This is not a comparative study, but rather deals with legislation and policy affecting land in Wales, placing them in the context of shared principles and concepts and the case law common to England and Wales. More than an academic exercise, planning is a practical matter affecting important aspects of daily life, and the desirability of public engagement in the planning process is well settled. This book contributes to the promotion of recognition of the body of Welsh planning law, to aid accessibility for all who practise in or who are (or want to be) involved in shaping development in Wales.

Book excerpt: The law relating to town and country planning has a major impact upon the physical environment and affects private citizens, landowners and developers alike. This third edition is a comprehensive text for students, practitioners and members of the general public on this difficult area of law. Following the Planning and Compulsory Purchase Act 2004, the third edition of Planning Law and Practice contains a complete revision of plan-making and the control of development as well as incorporating recent case law. Together this provides up-to-date details of the operation of the current English planning system. The successful format adopted in the first edition of this book, which was awarded the Gold Award for Best Reference Work by the Chartered Institute of Building in 1999, has been retained. Planning legislation is dealt with in the main chapters, while further chapters use relevant case law to amplify the sometimes complex statutory material. In addition, the book outlines other areas of land law such as European legislation, non-planning controls and public investment.

Book excerpt: This book provides valuable guidance and insight into the key features of the town and country planning system and the process of obtaining planning permission for development of land. Book Administrative Law and The Administrative Court in Wales

Download or read book Administrative Law and The Administrative Court in Wales written by David Gardner and published by University of Wales Press. This book was released on 2016-09-20 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: As we progress into the twenty-first century, Wales is acquiring a new identity and greater legislative autonomy. The National Assembly and the Welsh Government have power to create laws specifically for Wales. In parallel, the judicial system in Wales is acquiring greater autonomy in its ability to hold the Welsh public bodies to account. This book examines the principles involved in challenging the acts and omissions of Welsh authorities through the Administrative Court in Wales. It also examines the legal provisions behind the Administrative Court, the principles of administrative law, and the procedures involved in conducting a judicial review, as well as other Administrative Court cases. Despite extensive literature on public and administrative law, none are written solely from a Welsh perspective: this book examines the ability of the Welsh people to challenge the acts and omissions of Welsh authorities through the Administrative Court in Wales.

Book Wales and Whitehall

Download or read book Wales and Whitehall written by Great Britain: Parliament: House of Commons: Welsh Affairs Committee and published by The Stationery Office. This book was released on 2010-03-26 with total page 246 pages. Available in PDF, EPUB and Kindle. Book excerpt: The effective operation of devolution stands the best chance of success if both the UK and Welsh governments share knowledge and understanding, concludes the Welsh Affairs Committee in this report. The Committee makes a number of recommendations to improve the relationship between Wales and Whitehall. A broad review of how intergovernmental relationships are coordinated is required. The Joint Ministerial Committee should meet on a regular basis and ministers at all levels should be alert to the consequences of policy and legislation on devolved areas. The Cabinet Office should take lead responsibility for devolution strategy in Whitehall. Whitehall has lost a focus on the devolution settlement and too often has displayed poor knowledge and understanding of the specificities of the Welsh settlement. The Civil Service needs more consistent training and clear department-by-department focus on retaining devolution knowledge and understanding. The Welsh Assembly Government should have the confidence to interact with Whitehall and to promote areas of good practice. The Cabinet Secretary and the Permanent Secretary to the Welsh Assembly Government should give evidence annually to the Welsh Affairs Committee. Finally, reform of the Barnett Formula is required. The current financial settlement does not appear sustainable and a new arrangement needs to be built on an agreed and enduring basis which is demonstrably fair and sensitive to the particular circumstances of Wales.
