Book excerpt: Excerpt from Pennsylvania Trial Evidence The principles of law which govern a case can usually be de termined in advance, and such authorities as may be deemed necessary to sustain them collected before actual trial. On the other hand, it is impossible to foresee all questions of evidence which may arise and call for immediate decision in the course of the trial, and when such questions do arise it is important to have at hand some means of determiningwhether or not there are any decisions in point. While the fundamental rules and prin ciples of evidence are substantially of universal application and vary but little in different jurisdictions, _and have been fully treated in the various text-books on the subject, yet there are many instances where the decisions of different states vary in the application of those principles or where statutory enactments have made material changes, as in Pennsylvania. This offers a field for a local work of this kind, which is not covered in the general text-books on evidence, and which, though treated gen erally in the various digests of statutes and decisions in our state, is necessarily covered in such manner as to render the use of such volumes inconvenient for quick reference. It is with the hope of fulfilling this need that the author has endeavored in this volume to present the law of evidence in Pennsylvania in a con cise and practical form for ready reference either in the court room or in the preparation for trial.
