Book excerpt: Marine and terrestrial ecosystems are so fundamentally different in some aspects that many of the issues concerning biodiversity cannot be interpreted using a single theory of common application to all ecosystems. This article firstly gives the current statistics of Marine Biodiversity worldwide with India's contribution. Marine organisms comprise approximately a half of the total biodiversity, thus offering a vast source to discover useful therapeutics. In recent years, a significant number of novel metabolites with potent pharmacological properties have been discovered from the marine organisms. The 'marine world' boasts of innumerable life forms, each with a unique characteristic, making its genetic make-up the most sought after field for marine researchers. Coral reefs are known as the “rainforests of the sea,” it is exploited for cosmetics to pharmaceuticals patents. This research paper discusses the entire issues of exploiting marine biodiversity for Pharmaceutical Patents. Marine biodiversity contains most Phylogenetic and genomic diversity on Earth. Progress in marine and molecular technologies has facilitated “Bio prospecting,” with the number of patent claims associated with genes of marine organisms growing at 12% per year. The global market for marine biotechnology was estimated at U.S. $2.4 billion in 2004, with estimated average growth of 5.9% per year from 1999 to 2007. With this prospective this article concludes with the issues and challenges of Marine Biodiversity and Gene Patents with some suggestions.

Most patents are applied for inventions that are derived from terrestrial biotechnology. However, it is recognized that marine biotechnology offers a high potential to yield inventions as well. Marine biotechnology can be divided into two main areas. First, development of commercially viable drugs obtained from marine bioprospecting and, second, development of marine genetically modified organisms for aquacultural and environmental purposes. A patent means intellectual protection for an invention. Intellectual protection confers the exclusive right upon the patent holder to sell the right of utilization of the invention to interested parties. The selling of licenses provide one important way of receiving revenues for the research done for the invention. The prospect of potential revenues provide the incentive for investment into biotechnological research and subsequent patenting of inventions arising thereof. The overall aim of this work is to illustrate the close interrelationship of science and law by using marine biotechnology and patents as an example. Section two provides an overview on the scientific side of marine biotechnology. It will define marine biotechnology and investigate current advancements in marine biotechnology. Additionally, it roughly explains the international patent system governing inventions in the biotechnological area and provide examples on patents related to marine biotechnology. Section three illustrates the criticism expressed against life form patents in marine as well as terrestrial biotechnology. They hinder research and the objectives of biodiversity law. The legal and practical rules of physical and functional access vary in geometry. They focus on the valorization of research results, crystallizing conflicts of interest between suppliers and users. Sustainable research and development is essential to the knowledge and protection of marine biodiversity. The qualification of marine genetic resources in common, standard contractual tools, distributed research and development infrastructures, negotiation of an agreement on sustainable use and conservation of biodiversity beyond the limits of national jurisdiction, would To remove these inconsistencies.
