Book excerpt: Excerpt from Patent Term and Patent Disclosure Legislation: Hearing Before the Committee on Small Business, House of Representatives, One Hundred Fourth Congress, Second Session, Washington, DC, April 25, 1996 The Committee met, pursuant to notice, at 11 a.m., in room 2359, Rayburn House Office Building, Hon. Jan Meyers (Chair of the Committee) presiding. Chair Meyers. Good morning. The Committee will come to order. I think we have several people who are on their way, so I will go ahead and get started with a couple of opening remarks and welcome everyone who is here. At the outset, I would like to thank all of our witnesses for being here today. Particularly, Ms. Gardner, who has traveled all the way from San Diego to be with us; a long, long journey. Today we will be discussing two patent issues of importance to small business: Patent terms and patent disclosure. As most of you are aware, there are two different legislative approaches currently pending which address these issues: H.R. 359, which was introduced by Mr. Rohrabacher of California; and H.R. 1733, which was introduced by Mr. Moorhead of California. I personally am a cosponsor of H.R. 359. However, I realize that my colleagues here on the Committee have different views on these issues. I wanted to make sure that we heard from both sides today. While these issues of patent term and patent disclosure were addressed recently in our deliberations leading to the passage of GATT implementing legislation in the last Congress, I believe that many Members were not aware of the full reach of what was contained in every nook and cranny of the GATT accord which emerged from the Uruguay Round. I am a supporter of H.R. 359 for a couple of reasons. First, I believe that the previous system of 17 years of patent protection from the date of grant is more conducive to promoting American innovation and protecting the rights of small business inventors. This particular approach worked quite well for over 130 years. Moreover, I am very concerned about the premature disclosure of intellectual property. Many small businesses work hard to develop new innovations only to lose the ways to market their products to their full potential because of the premature release of technical information. Publication should occur after grant. America has a long and unique tradition of protecting intellectual property. Book US Patent Law for European Patent Professionals

Download or read book US Patent Law for European Patent Professionals written by A. Nickel and published by Kluwer Law International B.V.. This book was released on 2016-04-24 with total page 369 pages. Available in PDF, EPUB and Kindle. Book excerpt: Far more than a revised update, this new edition of a well-received guide to US patent law is twice as valuable to European patent practitioners as the previous edition. It is virtually a brand new book. The author, drawing on her recent years at a US firm, has augmented each chapter with practical information – including lines of argumentation to overcome obviousness rejections – and added new chapters, as well as much more detail on petitions and appeals, post-grant proceedings, and litigation. The new edition tells European practitioners not just about the framework of US patent law, but how it is applied. No other such book exists. With an overview of options at each stage of US patent prosecution and enforcement – with particular emphasis on its differences from the EPO system – the new edition details the available courses of action for all the procedural scenarios a European patent attorney is likely to encounter. The coverage is loaded with practical guidance on such aspects of US patent law and procedure as the following: · drafting applications and filing them at the US Patent Office; · applying provisions of the America Invents Act of 2011; · possible responses to a Final Office Action; · costs, fees, and time periods for various procedural actions; · using the US Manual of Patent Examination Procedure (MPEP); · declarations, oaths, and affidavits; · the Quick Path Information Disclosure Statement (QPIDS); · submissions on patentability by third parties; and · supplemental replies during examination proceedings. Every step in the process is described and directly compared as it operates under both the European Patent Convention (EPC) and US patent law. Any practitioner who has unsuccessfully tried to pursue in the US claims that were granted in the EPO will gain a new understanding of the reasons why – and what to do about it. In this highly practical, one-of-a-kind book, European patent professionals will find, detail by detail, exactly what is required at every stage of patent proceedings in the US. There is no other available source of such instantly accessible information for European patent lawyers, in-house counsel and paralegals, or EPC or national patent office officials, to all of whom this book will be of immeasurable value and usefulness. Intellectual property law academics and students will also benefit from the book’s comparative approach.

Book Patent Protection for Second Medical Uses

Download or read book Patent Protection for Second Medical Uses written by Jochen Bühling and published by Kluwer Law International B.V.. This book was released on 2020-10-13 with total page 806 pages. Available in PDF, EPUB and Kindle. Book excerpt: AIPPI Series, Volume Number 2. The second edition of Patent Protection for Second Medical Uses is a practical guide on the ever-relevant and controversial topic ‘Second Medical Use’ (SMU) patents, which play a significant role in the potential second-line patent protection and have become increasingly important. This edition’s analysis sheds light on the availability of protection for second medical use claims and its legal basis, followed by a detailed look at the specifics of various jurisdictions. Following the abandoning of ‘Swiss-type claims’ at the European Patent Office (EPO), applicants had to develop new filing strategies while such claims are still allowable in a number of national jurisdictions worldwide; the consequences of this have not yet fully been explored in practice. Jurisdictions around the world show significant differences in the treatment of such claims, although they share common approaches in patent law overall. This second edition furnishes a detailed and elaborate analysis, providing clarity, insight and guidance on legal issues and practical implications of SMU claims in twenty-four jurisdictions (the EPO and twenty-three individual countries). What’s in this book: This book, published under the aegis of the esteemed International Association for the Protection of Intellectual Property (AIPPI), contains a chapter-wise analysis by carefully chosen authors known for their expertise and experience in this field. Each chapter highlights such issues and topics as the following: availability and scope of protection; validity of claims; enforcement; infringement and investigations; and procedural aspects and tactical recommendations. The AIPPI studied certain aspects of second medical use claims on the occasion of its Congress in Toronto in 2014. This led to its Resolution Q 238 – ‘Second medical use and other second indication claims’, which triggered this comparative law analysis and a copy of which is found at the end of this book. How this will help you: This book is an enlightening compendium of contributions from across the globe. It not only renders guidance to interested legal practitioners when filing a patent application and assessing risks of conflict with existing patents or patent applications but also explains the key issues and contains practical advice when enforcing such claims or defending against an action. Also, this book will prove to be of immense practical interest for patent lawyers and patent attorneys and for the industries involved, applicants for pharmaceutical patents and third parties.
