Because of a shortened product of life cycle, increasing costs of R&D, many managers adopt the concept of open innovation. The market for patent licensing and monetization grows rapidly, as Open Innovation becomes the de facto management philosophy at more and more firms. Unfortunately, there are many obstacles while trading patents; therefore, patent intermediaries join the market. As the patent market grows, there is a diversity of patent intermediaries. However, studies about patent intermediaries are still lacking. Although a few studies mention patent intermediaries, they discuss how patent intermediaries run their business and what roles they play. The purpose of this thesis is to discuss what value patent intermediaries create in the patent market and how they do it. In this study, based on Amit and Zott's (2001) value creation configuration, we discuss the value creation model of intermediaries for the patent market. We used a case study and expert interviews. We choose some representative patent intermediaries from abroad and in Taiwan. The interviewees are executives and directors in the organisations. The result appears that patent intermediaries provide integrated services to their clients. They create value based on four dimensions: efficiency, complementarities, lock-in, and novelty. Building a long-term relationship and trust with clients or members is the key success factors.

Book excerpt: Liability rules affect the incentives of intermediaries to disseminate and curate creative works, in particular when works build on the work of predecessors and they are potentially infringing copyright. In an application to the visual arts, we show that appropriation artists borrow images from different sources and incorporate them into new, derivative works of art. By doing so, they risk infringing copyright but also put commercial trade and availability of the work at litigation risk as liability can extend to intermediaries in markets (auction houses) or in public exhibitions (museums). Using a differences-in-differences model and unique data on the level of the individual art work, we empirically investigate the impact of the prominent 2013 Cariou v. Prince U.S. court decision on trade and availability in Appropriation Art.

Available in PDF, EPUB and Kindle. Book excerpt: Recent work suggests that Patent Assertion Entities (PAEs) -- or “patent trolls” -- are a new form of financial intermediary. According to this view, individual patent holders are unable to contract with large manufacturers because they lack the financial resources necessary to litigate against infringement. Since individual patent holders are heterogeneous in their constraints and preferences, the market function of PAEs should depend on their specific demands. We conducted an experiment in which subjects from a population of interest were each assigned patents that were infringed by large manufacturers in a hypothetical scenario. We relaxed the financial constraints of some patent holders and evaluated whether this randomized intervention subsequently reduced the demand for PAEs relative to costly litigation. Our results indicate that PAEs served an intermediary function for two groups in our sample: subjects who identified as inventors rather than entrepreneurs, and subjects who were relatively more sensitive to financial losses.
