Download or read book Multilevel Protection of the Principle of Legality in Criminal Law written by Mercedes Pérez Manzano and published by Springer. This book was released on 2017-10-24 with total page 237 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the simultaneous protection of fundamental rights by various norms and jurisdictional organs, focussing on the multilevel protection of the principle of legality in Criminal Law.Written by accredited specialists in criminal law, constitutional law, international public law, and the philosophy of law, the majority of them ex-Counsels of the Spanish Constitutional Court, it addresses various manifestations of the principle of legality: the requirement of precision, the judicial subjection to law and the prohibition of bis in idem. It does so not only from a theoretical perspective, but also through a comparative study of the jurisdiction of the European Court of Human Rights, the Inter-American Court of Human Rights, the Court of Justice of the European Union and state constitutional courts. This practical approach characterizes the book, which culminates in a detailed analysis of the relevant ECtHR Judgement Del Río Prada v. Spain on the retroactivity of unfavourable jurisprudence."Multilevel protection of the principle of legality in Criminal Law" is a useful instrument of reflection for scholars of both the principle of criminal legality and the problems that arise from the concurrency of protective jurisdictions of human rights.

It is both comprehensive and concise. This book takes a conceptual rather than chronological approach to topics. With focussed rather than lengthy case extracts, the book explains what the law is and why various interpretations have been adopted. Book The Oxford Handbook of the Australian Constitution

Download or read book The Oxford Handbook of the Australian Constitution written by Cheryl Saunders and published by Oxford University Press. This book was released on 2018-03-01 with total page 1198 pages. Available in PDF, EPUB and Kindle. Book excerpt: Constitutional law provides the legal framework for the Australian political and legal systems, and thus touches almost every aspect of Australian life. The Handbook offers a critical analysis of some of the most significant aspects of Australian constitutional arrangements, setting them against the historical, legal, political, and social contexts in which Australia's constitutional system has developed. It takes care to highlight the distinctive features of the Australian constitutional system by placing the Australian system, where possible, in global perspective. The chapters of the Handbook are arranged in seven thematically-grouped parts. The first, 'Foundations', deals with aspects of Australian history which have influenced constitutional arrangements. The second, 'Constitutional Domain', addresses the interaction between the constitution and other relevant legal systems and orders, including the common law, international law, and state constitutions. The third, 'Themes', identifies themes of special constitutional significance, including the legitimacy of the constitution, citizenship, and republicanism. The fourth, 'Practice and Process', deals with practical issues relevant to constitutional litigation, including the processes, techniques, and authority of the High Court of Australia. The final three parts deal with the structural building blocks of the Australian Constitutional system: 'Separation of Powers', 'Federalism', and the 'Protection of Rights.' Written by a team of experts drawn from academia and practice, the Handbook provides Australian and international readers alike with a reliable source of knowledge, understanding, and insight into the Australian Constitution.

Book Rivalry and Alliance Politics in Cold War Latin America

Download or read book Rivalry and Alliance Politics in Cold War Latin America written by Christopher Darnton and published by JHU Press. This book was released on 2014-06-30 with total page 298 pages. Available in PDF, EPUB and Kindle. Book excerpt: The success or failure of foreign policy initiatives in Latin America is heavily influenced by bureaucratic and military background players. Rivalry and Alliance Politics in Cold War Latin America, Christopher Darnton’s comparative study of the nature of conflict between Latin American states during the Cold War, provides a counterintuitive and shrewd explanation of why diplomacy does or doesn’t work. Specifically, he develops a theory that shows how the “parochial interests” of state bureaucracies can overwhelm national leaders’ foreign policy initiatives and complicate regional alliances. His thorough evaluation of several twentieth-century Latin American conflicts covers the gamut of diplomatic disputes from border clashes to economic provocations to regional power struggles. Darnton examines the domestic political and economic conditions that contribute either to rivalry (continued conflict) or rapprochement (diplomatic reconciliation) while assessing the impact of U.S. foreign policy. Detailed case studies provide not only a robust test of the theory but also a fascinating tour of Latin American history and Cold War politics, including a multilayered examination of Argentine-Brazilian strategic competition and presidential summits over four decades; three rivalries in Central America following Cuba’s 1959 revolution; and how the 1980s debt crisis entangled the diplomatic affairs of several Andean countries. These questions about international rivalry and rapprochement are of particular interest to security studies and international relations scholars, as they seek to understand what defuses regional conflicts, creates stronger incentives for improving diplomatic ties between states, and builds effective alliances. The analysis also bears fruit for contemporary studies of counterterrorism in its critique of parallels between the Cold War and the Global War on Terror, its examination of failed rapprochement efforts between Algeria and Morocco, and its assessment of obstacles to U.S. coalition-building efforts.

Book Pinochet s Economic Accomplices

Download or read book Pinochet s Economic Accomplices written by Juan Pablo Bohoslavsky and published by Rowman & Littlefield. This book was released on 2021-01-12 with total page 461 pages. Available in PDF, EPUB and Kindle. Book excerpt: With a focus on Chile, Pinochet’s Economic Accomplices: An Unequal Country by Force uses theoretical arguments and empirical studies to argue that focusing on the behavior of economic actors of the dictatorship is crucial to achieve basic objectives in terms of justice, memory, reparation, and non-repetition measures. This book makes visible a number of cases of economic complicity with the Chilean dictatorship and explains their links with the radical inequalities the country has today while proposing a theoretical framework for their study. Scholars of Latin American studies, history, sociology, economics, business, and human rights will find this book particularly useful.

Book The Oxford Handbook of Criminal Law

Download or read book The Oxford Handbook of Criminal Law written by Markus D Dubber and published by OUP Oxford. This book was released on 2014-11-27 with total page 1294 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Oxford Handbook of Criminal Law reflects the continued transformation of criminal law into a global discipline, providing scholars with a comprehensive international resource, a common point of entry into cutting edge contemporary research and a snapshot of the state and scope of the field. To this end, the Handbook takes a broad approach to its subject matter, disciplinarily, geographically, and systematically. Its contributors include current and future research leaders representing a variety of legal systems, methodologies, areas of expertise, and research agendas. The Handbook is divided into four parts: Approaches & Methods (I), Systems & Methods (II), Aspects & Issues (III), and Contexts & Comparisons (IV). Part I includes essays exploring various methodological approaches to criminal law (such as criminology, feminist studies, and history). Part II provides an overview of systems or models of criminal law, laying the foundation for further inquiry into specific conceptions of criminal law as well as for comparative analysis (such as Islamic, Marxist, and military law). Part III covers the three aspects of the penal process: the definition of norms and principles of liability (substantive criminal law), along with a less detailed treatment of the imposition of norms (criminal procedure) and the infliction of sanctions (prison law). Contributors consider the basic topics traditionally addressed in scholarship on the general and special parts of the substantive criminal law (such as jurisdiction, mens rea, justifications, and excuses). Part IV places criminal law in context, both domestically and transnationally, by exploring the contrasts between criminal law and other species of law and state power and by investigating criminal law's place in the projects of comparative law, transnational, and international law.

Book Regulating Fraud Across Borders

Download or read book Regulating Fraud Across Borders written by Edgardo Rotman and published by Bloomsbury Publishing. This book was released on 2021-02-25 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: At a time when financial crime routinely crosses international boundaries, this book provides a novel understanding of its spread and criminalisation. It traces the international convergence of financial crime regulation with a uniquely comparative approach that examines key institutional and state actors including the European Union, the International Organization of Securities Commissions, as well as the United States, the United Kingdom, Switzerland, France, Italy and Germany, all countries that harbour some of the most influential stock exchanges in the Western world. The book describes and documents the phenomenon of internationalisation of securities frauds – such as insider trading and market manipulation – and the laws criminalising those acts, most notably those responding to recent dramatic transformations in securities markets, high frequency trading, and benchmark manipulation. At the European level, it shows the progressive uniformisation of laws culminating in the 2014 European Union Market Abuse Regulation. The book argues that criminal prohibitions against internationalised market abuse must be understood as an economic and legal imperative to protect financial markets against activities that imperil its integrity, compromising the confidence of investors and thus affecting the economy as a whole. The book is supported by an extensive review of the most significant scholarship in each country.
